• r r O',DII' ITCE No. - ] 7 ci2 AN ORDINANCE providing for the improvement of Hewitt Avenue from the West margin of Virginia Avenue to the East margin of State Street by removal of existing asphalt, repairing existing concrete base and resurfacing with Fortland Cement Concrete, construction of integral concrete curbs, the center strip of existing concrete pavement to be resurfaced with concrete asphalt and repair sidewalks as found necessary, installation of necessary drainage , and doing all other work necessary in connection there- with to make a complete iniprover.ent, all in accordance with Resolution No. 4414 of the City of yverett ; creating an enlarged assessment district which shall be divided into a direct benefit district and an indirect benefit district ; creating a local improvement district fund therefor; providing that the cost of the improvement, not to exceed. Fifty-five percent ( 55r1) , Plus the fixed estimate, be paid by special assessment upon the property in said district under the mode of payment by bonds, and the balance thereof shall be paid from funds allocated to the City of Everett by the federal grant of the United States Govern- ment under PWA; WHEREAS, by Resolution No. 4414 of the City of Everett the City Council has declared its intention to order the improve- ment as above outlined, and doing all other work in connection therewith to make a complete improvement in accordance with the plans and specifications prepared by the City Engineer of the City of Everett. NOW, THEREFORE, THE CITY O ' EVRETT DOES ORDAIN: Section 1: That Hewitt Avenue from the West margin of Virginia .':venue to the East margin of State Street be improved by removal of existing asphalt, repairing existing concrete base and resurfacing with Portland Cement Concrete, construction of integral concrete curbs, the center strip of existing concrete pavement to be resurfaced with concrete asphalt and repairing sidewalks as found necessary, installation of necessary drainage and doing all other work necessary to make a complete improvement , all according to the plans and specifications prepared under the direction of the City�Engineer, which plans and specifications are hereby adopted and approved. Section 2: A sum not to exceed Fiftyfive percent ( 55%) of the cost and expense of such improvement, plus fixed estimate , shall be borne by and assessed against the property included in the enlarged assessment district, which shall be divided into a direct benefit district and an indirect benefit district, herein created in accordance with law. The balance of the cost thereof shall be paid by funds allocated to the City of Everett by the federal grant of the Lnited States Government under PWA. iThe City of Everett shall not be liable in any manner for any portion of the cost and expense of such improvement , except as provided in Chapter 141 Session haws of ashington of 1923, and acts amendatory thereto, end the ordinances of said city. Section3: There is hereby established an enlarged local improvement district to be called 'Local Improvement Dis- trict :. o. .E2. , " which said enlarged district shall be divided into a direct benefit district and an indirect benefit district. Said direct district shall include all the following described property, to-wit:
