• <br /> r r <br /> O',DII' ITCE No. - ] 7 ci2 <br /> AN ORDINANCE providing for the improvement of Hewitt <br /> Avenue from the West margin of Virginia Avenue to the East margin <br /> of State Street by removal of existing asphalt, repairing existing <br /> concrete base and resurfacing with Fortland Cement Concrete, <br /> construction of integral concrete curbs, the center strip of <br /> existing concrete pavement to be resurfaced with concrete asphalt <br /> and repair sidewalks as found necessary, installation of necessary <br /> drainage , and doing all other work necessary in connection there- <br /> with to make a complete iniprover.ent, all in accordance with <br /> Resolution No. 4414 of the City of yverett ; creating an enlarged <br /> assessment district which shall be divided into a direct benefit <br /> district and an indirect benefit district ; creating a local <br /> improvement district fund therefor; providing that the cost of <br /> the improvement, not to exceed. Fifty-five percent ( 55r1) , Plus <br /> the fixed estimate, be paid by special assessment upon the <br /> property in said district under the mode of payment by bonds, <br /> and the balance thereof shall be paid from funds allocated to the <br /> City of Everett by the federal grant of the United States Govern- <br /> ment under PWA; <br /> WHEREAS, by Resolution No. 4414 of the City of Everett <br /> the City Council has declared its intention to order the improve- <br /> ment as above outlined, and doing all other work in connection <br /> therewith to make a complete improvement in accordance with the <br /> plans and specifications prepared by the City Engineer of the <br /> City of Everett. <br /> NOW, THEREFORE, THE CITY O ' EVRETT DOES ORDAIN: <br /> Section 1: That Hewitt Avenue from the West margin <br /> of Virginia .':venue to the East margin of State Street be improved <br /> by removal of existing asphalt, repairing existing concrete <br /> base and resurfacing with Portland Cement Concrete, construction <br /> of integral concrete curbs, the center strip of existing concrete <br /> pavement to be resurfaced with concrete asphalt and repairing <br /> sidewalks as found necessary, installation of necessary drainage <br /> and doing all other work necessary to make a complete improvement , <br /> all according to the plans and specifications prepared under the <br /> direction of the City�Engineer, which plans and specifications <br /> are hereby adopted and approved. <br /> Section 2: A sum not to exceed Fiftyfive percent <br /> ( 55%) of the cost and expense of such improvement, plus fixed <br /> estimate , shall be borne by and assessed against the property <br /> included in the enlarged assessment district, which shall be <br /> divided into a direct benefit district and an indirect benefit <br /> district, herein created in accordance with law. The balance of <br /> the cost thereof shall be paid by funds allocated to the City of <br /> Everett by the federal grant of the Lnited States Government under <br /> PWA. iThe City of Everett shall not be liable in any manner for <br /> any portion of the cost and expense of such improvement , except <br /> as provided in Chapter 141 Session haws of ashington of 1923, and <br /> acts amendatory thereto, end the ordinances of said city. <br /> Section3: There is hereby established an enlarged <br /> local improvement district to be called 'Local Improvement Dis- <br /> trict :. o. .E2. , " which said enlarged district shall be <br /> divided into a direct benefit district and an indirect benefit <br /> district.
