The lack of landscape maintenance on the property including the trees cut along the <br /> north lot line and the presence of garbage, litter, discarded items and overgrown <br /> and/or noxious vegetation are violations of EMC 8.20.020 A & E and 19.35.130.A, <br /> which read: <br /> EMC 8.20.020 Nuisances—Residential property and nonresidential <br /> property. <br /> Except as authorized by subsection H of this section or as may be allowed by <br /> another city ordinance, no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall <br /> maintain or allow to be maintained on the property outside of a fully enclosed <br /> structure such as a shed, dwelling, or closeable garage, any of the following <br /> conditions visible from any street, alley, or other public or private property: <br /> A. Junk, trash, litter, boxes, discarded lumber, salvage materials or other similar <br /> materials; <br /> E. Dead, decayed, diseased, noxious or hazardous trees or vegetation, or any <br /> vegetation (not including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height; <br /> EMC 19.35.130 Landscape maintenance and maintenance assurance <br /> requirements. <br /> A. All landscape areas required by this title shall be maintained in accordance <br /> with the following standards: <br /> 1. All landscaping shall be maintained with respect to pruning, trimming, <br /> mowing, watering, insect control, fertilizing, or other requirements to create a <br /> healthy growing condition, attractive appearance, and to maintain the purpose of <br /> the landscape type. <br /> a. Pruning of trees must be consistent with ANSI A300(Part 1)American <br /> National Standard for Tree Care Operations—Tree, Shrub, and Other Woody Plant <br /> Management—Standard Practices(Pruning)and companion publication Best <br /> Management Practices Tree Pruning. The topping, shearing or pollarding of trees is <br /> prohibited. <br /> b. Required trees shall not be pruned to maintain a height below twenty feet, <br /> except as required under power lines or as approved through the landscape <br /> modification process in Section 35.070.A.5. <br /> c. Portions of trees that extend over areas used by pedestrians or vehicle <br /> maneuvering or parking areas, or that abut driveways, shall be limbed up to a <br /> height of seven feet to maintain pedestrian and vehicle clearance and dear lines of <br /> sight. <br /> 2. Dead, diseased, stolen, vandalized, improperly pruned, or damaged plants <br /> shall be replaced within three months, with the plants indicated on the approved <br /> landscape plan. <br /> 3.
