`ref® °mats'®n At: t C t t of Everet Cock Vi®ll tiions Hearings <br /> If you receive a violation citation fm the City's of Everett's Code Enforcement unit,you should know the <br /> following information. Persons tohom violation citations are issued are called"respondents." The issuance of <br /> a violation citation (VC) results in hearing in front of the City.'s Violations Hearing Examiner. The date,time, <br /> and place of the hearing are included in the VC. Respondents are expected to attend this hearing. <br /> If a respondent is not a repeat violator1 and has completed the corrective action described in the VC,he/she is <br /> eligible to enter into a stipulated agreed order with the city. An agreed order means that the City agrees not to <br /> take further action against the respondent for the violations described in the VC as long as there are no further <br /> same/sirriilar code violations for two years. An eligible respondent who enters into an agreed order with the <br /> City is no longer required to appear at the hearing. Contact the Code Enforcement Officer who signed the VC to <br /> schedule an Inspection of your property if you wish to apply for an agreed order. <br /> At code violation hearings,Code Enforcement Staff will present evidence to the Hearing Examiner,including <br /> photographs depicting the violation(s),the VC,other notices,information about the property,and a proposed <br /> order asking for a specific outcome. The hearing is your opportunity to present evidence In response to the VC, <br /> including evidence that seeks to show that some or all of the violations did not occur,that the violations have <br /> already been corrected,or any other information you think is relevant. You may bring witnesses,photographs, . <br /> and documents to the hearing to help you make your case. You may present comments in writing and verbally. <br /> You may bring an attorney but you are not required to be represented. <br /> Following the hearing,the Hearing Examiner will issue an Order determining whether or not the violations <br /> occurred,even if you do not attend the hearing.The Hearing Examiner's Order typically: <br /> A. Determines whether the violations alleged in this citation did occur; <br /> R. Requires that the violations be corrected by a specific date; <br /> C. Imposes a monetary penalty in accordance with Chapter 1.20 EMC(typically$500 per violation); <br /> and <br /> D. Authorizes the City to enter the property,correct the violations,and to assess the costs of the <br /> . corrections,as permitted by law. <br /> • <br /> if you would like to see a copy of the City's exhibits before the hearing,contact the assigned Code Enforcement <br /> Officer at least two business days before the hearing to make the request. A copy of the proposed order can be <br /> picked up the day before the hearing at the Police Department Records Unit counter located on the first floor at <br /> 3002 Wetmore Avenue. 'Take the case number'with you when you go to pick them up. <br /> The proposed order contains"default" language that will be removed if you attend the hearing.
