Order#13273, Corps Reference#1VWS-2013-1077 <br /> • Smith Island Terminal,LLC <br /> May 4, 2016 <br /> Page 2 of 18 <br /> • Area 1: Create 2.4 acres of freshwater wetland habitat immediately north of the Cedar <br /> Grove composting facility. This mitigation area was installed in 2004. <br /> • Area 2: Restore the heavily degraded upland habitat adjacent to the blind slough to <br /> approximately 5.7 acres of intertidal habitat, and convert approximately 2.9 acres of <br /> palustrine wetland and the blind slough into intertidal habitat. This includes removal of <br /> an existing tidegate, setting back the existing levee approximately 250 feet, and <br /> installation of a self-regulating two-way tide gate in the setback levee. <br /> • Area 3: Excavate disturbed upland areas to create an additional 1.8 acres of estuarine <br /> habitat. Wetland conversion in this area will be 0.04 acre. This includes removal of 100 <br /> linear feet of the existing levee, excavation of tidal channels, and construction of a new <br /> setback levee that connects to the Area 2 self-regulating two-way tide gate. <br /> • Area 4: Remove approximately 550 linear feet of the levee adjacent to Union Slough and <br /> create intertidal habitat in 6.15 acres of the mitigation area. Wetland conversion in this <br /> area will be 1.36 acres. This includes construction of a new setback levee, a pedestrian <br /> bridge, and a public parking area. <br /> • Establish and enhance upland buffers around the wetland mitigation areas, including <br /> preservation of approximately 11.6 acres of tidelands and removal of at least 20 creosote- <br /> treated wooden piles from the tidelands. <br /> The project is located at 36th Place NE, Everett, Snohomish County, Washington, Wetlands, <br /> Lower Snohomish River Estuary, Section 5, T. 29 N., R. 5E., WRIA 7. <br /> AUTHORITIES: <br /> In exercising authority under 33 U.S.C. § 1341, RCW 90.48.120,and RCW 90.48.260, Ecology <br /> has examined this application pursuant to the following: <br /> 1. Conformance with applicable water quality-based, technology-based, and toxic or <br /> pretreatment effluent limitations as provided under 33 U.S.C. §§ 1311, 1312, 1313, 1316, <br /> and 1317 (FWPCA §§ 301, 302, 303, 306 and 307); <br /> 2. Conformance with the state water quality standards contained in Chapter 173-201A WAC <br /> and authorized by 33 U.S.C. § 1313 and by Chapter 90.48 RCW, and with other <br /> applicable state laws; and <br /> 3. Conformance with the provision of using all known, available and reasonable methods to <br /> prevent and control pollution of state waters as required by RCW 90.48.010. <br />
