C. Water Quality Conditions: Order#13273, Corps Reference#NWS-2013-1077 <br /> Smith Island Terminal,LLC <br /> May 4, 2016 <br /> Page 8of18 <br /> Cl. This Order does not authorize temporary exceedances of water quality standards beyond <br /> the limits established in WAC 173-201A-210(1)(e)(i). <br /> C2. The Applicant shall conduct in-water construction water quality sampling and monitoring <br /> as described in the Water Quality Monitoring and Protection Plan, Smith Island <br /> Terminal, Everett, Washington,prepared by GeoEngineers,Inc., dated March 14,2016 <br /> (hereafter referred to as the Water Quality Monitoring Plan), as well as the clarifications <br /> described in the Letter from Wayne Wright and Adam Wright, GeoEngineers, Inc., to <br /> Rebekah Padgett, Ecology, dated April 29,2016, or as modified by this Order or revised <br /> and approved by Ecology. <br /> D. Conditions for Construction Activities: <br /> Upland Conditions: <br /> D l. Applicant shall obtain and comply with a Construction Stormwater General Permit for <br /> this project. <br /> D2. Applicant shall obtain and comply with an Industrial Stormwater General Permit for this <br /> project. <br /> D3. Construction stormwater, sediment, and erosion control best management practices <br /> (BMPs; e.g., filter fences, etc.) suitable to prevent exceedances of state water quality <br /> standards shall be in place before starting construction at the site. <br /> D4. Sediment and erosion control measures shall be inspected and maintained prior to and <br /> during project implementation. <br /> D5. Machinery and equipment used during construction shall be serviced, fueled, and <br /> maintained upland,unless otherwise approved by Ecology, in order to prevent <br /> contamination to any surface water. <br /> D6. Wash water containing oils, grease, or other hazardous materials resulting from wash <br /> down of equipment or working areas shall be contained for proper disposal, and shall not <br /> be discharged into state waters or storm drains. <br /> D7. All construction debris shall be properly disposed of on land so that it cannot enter a <br /> waterway or cause water quality degradation to state waters. <br /> D8. Clean Fill Criteria: Applicant shall ensure that fill(soil)placed for the proposed project <br /> does not contain toxic materials in toxic amounts. <br />
