1 <br />AMENDMENT NO. 1 <br />TO AGREEMENT FOR INDIGENT DEFENSE SERVICES <br />BETWEEN THE CITY OF EVERETT <br />AND EVERETT LAW ASSOCIATION <br /> <br /> This Amendment No. 1 to Agreement for Indigent Defense Services (this <br />“Amendment”) is dated as of the date of last signature below. It is by and between the <br />City of Everett, a municipal corporation under the laws of the State of Washington (“City”) <br />and Everett Law Association (“Public Defender”). <br /> <br />RECITALS <br /> <br /> A. The City and Public Defender are parties to the Agreement for Indigent <br />Defense Services dated November 8, 2018 (the “Agreement”). All capitalized terms in <br />this Amendment are as defined in the Agreement. Under the Agreement, the Public <br />Defender provides indigent defense services in connection with the Everett Municipal <br />Court. <br /> <br /> B. The term of the Agreement is January 1, 2019, to December 31, 2023. The <br />purpose of this Amendment is to extend the Agreement for five additional years, so that <br />the term of the Agreement will end on December 31, 2028. This Amendment also makes <br />other changes. <br /> <br />AGREEMENT <br /> <br />The City and Public Defender agree as follows: <br /> <br />1. The Agreement is modified to extend the Agreement for five years, so that the term <br />of the Agreement ends December 31, 2028. <br /> <br />2. If the City determines to issue an RFP for indigent defense services, the City may <br />terminate this Agreement upon one year’s prior written notice to Public Defender, <br />which notice will state the effective date of termination. The effective date of <br />termination may not be before December 31, 2024. This termination right is in <br />addition to any other termination right that may exist in the Agreement. <br /> <br />3. The following are added to Section 1 of the Agreement: <br /> <br />1.9 Effective January 1, 2024, Public Defender shall accept all <br />discovery in electronic form via email or via other electronic means. <br /> <br />1.10 Effective July 1, 2023, Public Defender shall schedule all interviews <br />(including telephonic interviews) with Everett police officers during <br />the officer’s regularly scheduled shift. <br /> <br />4. Effective January 1, 2024, Section 1.7 is deleted from the Agreement. This means <br />Public Defender will no longer be required to have a principal court liaison as of <br />that date. <br />
