r • ORDINANCE No. 2770 AN ORDINANCE providing for the improvement of an alley between Maple and Yyralnut Streets from 9th Street to llth Street, also Walnut Street between 9th Street and llth Street by the construction of a sewer and necessary appurtenances, and doing all other work in the entire district necessary to make a complete improvement ; creating an assessment district; creating a local improvement district fund therefor; providing that the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materials used, including fixed estimate and all other expenses , except cost of labor furnished by Federal funds under WPA plan of the Federal Government. WHEREAS, a majority petition of the property owners Petitioning for said improvement has heretofore been filed with t e City Council, and upon examination thereof the said City Council has found the things set forth therein to be true; and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by the said Commissioner and the Engineer, and the Comissioner of Public Works has filed with the City Council all data and information as required by law; and WHEREAS, the said Commissioner of Publics corks has recommended to the City Council that said improvement petitioned for be made and it appearing to the City Council that the public health, convenience and necessity require such improvement be made; and WHEREAS, it further appears that such improvement should be made only in the event that Federal funds may be secured from the WPA for the payment of labor costs, and the property in the said district be assessed a sum for the cost of all materials , fixed estimate and all Gothermenpenses esrof,?Peveryd kind not provided for by the Federal , that such improvement should only be commenced upon the assurance that the Federal Government under WPA will furnish said labor costs in connection with said improvement. NOW, THEREFORE, the City of Everett DOES ORDAIN: Section 1: That the alley between Maple and Walnut Streets between 9th Street and llth Street and also Walnut Street between 9th Street and llth Street be improved by the construction of a sewer and all necessary appurtenances, and doing all other work in the entire district necessary to make a complete improvement according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materials required to make a complete improvement , the fixed estimate end all other expenses of every kind, except cost of labor contributed by the Federal Government under `TPA shall be borne by and assessed against the property included in the assessment district herein created in accordance with law.
