r • <br /> ORDINANCE No. 2770 <br /> AN ORDINANCE providing for the improvement of an alley <br /> between Maple and Yyralnut Streets from 9th Street to llth Street, <br /> also Walnut Street between 9th Street and llth Street by the <br /> construction of a sewer and necessary appurtenances, and doing <br /> all other work in the entire district necessary to make a <br /> complete improvement ; creating an assessment district; creating <br /> a local improvement district fund therefor; providing that the <br /> payment of said improvement be made by special assessment on the <br /> property in said district under the mode of payment by bonds <br /> for materials used, including fixed estimate and all other <br /> expenses , except cost of labor furnished by Federal funds under <br /> WPA plan of the Federal Government. <br /> WHEREAS, a majority petition of the property owners <br /> Petitioning for said improvement has heretofore been filed with t e <br /> City Council, and upon examination thereof the said City Council <br /> has found the things set forth therein to be true; and <br /> WHEREAS, the said petition has been referred to the <br /> Commissioner of Public Works to be examined by the said <br /> Commissioner and the Engineer, and the Comissioner of Public <br /> Works has filed with the City Council all data and information <br /> as required by law; and <br /> WHEREAS, the said Commissioner of Publics corks has recommended <br /> to the City Council that said improvement petitioned for be made <br /> and it appearing to the City Council that the public health, <br /> convenience and necessity require such improvement be made; and <br /> WHEREAS, it further appears that such improvement <br /> should be made only in the event that Federal funds may be <br /> secured from the WPA for the payment of labor costs, and the <br /> property in the said district be assessed a sum for the cost of <br /> all materials , fixed estimate and all Gothermenpenses esrof,?Peveryd <br /> kind not provided for by the Federal , <br /> that such improvement should only be commenced upon the assurance <br /> that the Federal Government under WPA will furnish said labor <br /> costs in connection with said improvement. <br /> NOW, THEREFORE, the City of Everett DOES ORDAIN: <br /> Section 1: That the alley between Maple and Walnut <br /> Streets between 9th Street and llth Street and also Walnut <br /> Street between 9th Street and llth Street be improved by the <br /> construction of a sewer and all necessary appurtenances, and <br /> doing all other work in the entire district necessary to make a <br /> complete improvement according to the plans and specifications <br /> prepared under the direction of the City Engineer, which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of all <br /> materials required to make a complete improvement , the fixed <br /> estimate end all other expenses of every kind, except cost of <br /> labor contributed by the Federal Government under `TPA shall be <br /> borne by and assessed against the property included in the <br /> assessment district herein created in accordance with law. <br /> The City of Everett shall not be liable in any manner for any <br /> portion of the cost and expense of such improvement, except as <br />
