ORDINANCE No. 2764 AN ORDINANCE vacating the following described portion of a street in the City of Everett, to-wit: That part of McDougall Street lying South of the South line of Hewitt Avenue for a distance of 104 feet, all in the city of Everett , Snohomish County, Washington, a nd declaring an emergency. WHAS, the owners of more than two-thirds of the private property abu ttin-:; upon McDougall Street have duly filed their petition with the City Council of the City of Everett praying for the vacation of a portion of said street; and WHEREAS, said City Council of the City of Everett did, by resolution duly adopted, fix the 28th day of January, • 1938, at 10 :00 o 'cl:wsck A. M . of said day for the hearing and determination of said petition; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said petition has been given by the City Clerk in the manner required by law; and WHEREAS, it appearing to the City Council that said petition should be granted, and said City Council does hereby determine to vacate said portion of said street. NOW, T_EREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following portion of McDougall Street , to-wit : That portion of McDougall Street lying South of the South line of Hewitt Avenue for a distance of 104 feet, all in the City of Everett , Snohomish Couny, Washington, be, and the same is hereby vacated, and the title to the land in said portion of said street above described , is hereby declared to vest in the abutting property owners as provided by law. Section 2: An emergency is declared to exist and this ordinance shall take effect upon its passage and publication.
