• ORDINANCE No. 777 AN ORDINANCE providing for the improvement of Hewitt Avenue from Grand Avenue to brick pavement West of Nassau Street , by removal of old wood blocks and center strips of existing concrete paverrent; construction of one course Port- land cement concrete pavement; new concrete curbs; repairing concrete sidewalks as found necessary; installation of necessary drainage , and doing all other work in connection therewith to make a complete improvement , all in accordance with Resolution AO. 4325 of the City of Everett; creating an assessment district; creating a local improvement district therefor; providing that said improvement be made by special assessment to the amount of Sixty percent (60 ) , plus Treasurer's fee and L. I. D. advertisement , upon the property in said dis- trict , under mode of payment by bonds, and the balance by funds allocated from the Washington State Motor Vehicle Fund to the City of Everett, and repealing ordinance i4o. 2738 of the City of Everett. WHEREAS, by Resolution No. 4325 of the City of Everett the City Council has declared its intention to order the improve- ment as above outlined, and doing all other work necessary in connection therewith to make a complete improvement , all in accordance with plans and specifications prepared by the City Engineer. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That Hewitt Avenue from Grand Avenue to brick pavement West of _Nassau Street be improved by removal of old wood blocks and center strips of existing concrete pavement ; construction of one course Portland cement concrete pavement; new concrete curbs; repairing concrete sidewalks as found necessary; installation of necessary drainage and doing all other work necessary in connection therewith to make a complete improvement , according to the plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement , including all necessary and incidental expense, to the amount of Sixty percent (60%) thereof, plus Treasurer's fee and L. I. D. advertisement , shall be borne by and assessed against the property included in the assessment district herein created, in accordance with law. The remaining amount not charged to the district shall be paid for out of funds allocated from the Washington State Motor Vehicle Fund to the City of Everett. The City of Everett shall not be liable in any manner for the cost and expense of such improve- ment except as provided in Chapter 141 Session Laws of Washington of 1923 and Ordinance No. 2126 of the City of Everett , and amendatory acts and ordinances thereto.
