June 28, 2023 <br /> <br />5 <br /> <br /> <br />AN ORDINANCE relating to violation of court orders, amending Chapter 10.13 Everett <br />Municipal Code <br /> <br />Moved by Council Member Zarlingo, seconded by Council Member Tuohy, that this is declared <br />to be the third and final reading of Council Bill No. 2306-34. <br /> <br />Lacey Offutt, Legal, provided answers to Council questions asked during the second reading of <br />the ordinance. <br /> <br />Discussion ensued regarding misdemeanor vs. gross misdemeanor charges and pre- and post- <br />conviction Stay Out of Drug Area (SODA) orders. <br /> <br />Moved by Council Member Fosse, seconded by Council Member Vogeli, to amend the violation <br />charge to be a misdemeanor instead of a gross misdemeanor. <br /> <br /> <br />Roll was called with all council members voting no, except Council Members Fosse and Vogeli <br />who voted yes, and Council Member Rhyne who was excused. <br /> Motion failed. <br /> <br /> <br />The City Clerk was directed to call the roll for the final deposition of the ordinance. <br /> <br /> AYES: Fosse, Schwab, Vogeli, Zarlingo, Stonecipher, Tuohy <br /> NAYES: None <br /> ABSENT: None <br /> <br />Ordinance No. 3962-23 adopted. <br /> <br />RESOLUTION – DRUG TRAFFICKING PROHIBITED AREAS <br /> <br />Moved by Council Member Zarlingo, seconded by Council Member Tuohy, to adopt Resolution <br />No. 7905, establishing Prohibited Areas related to areas of drug trafficking. <br /> <br />Considerable discussion ensued regarding adjusting the SODA orders addressing drug use in City <br />Parks. Police Chief Dan Templeman, Lacey Offutt and David Hall, Legal, responded to Council <br />questions. <br /> <br />David Hall, Legal, stated that to amend the Resolution, it must pass with a majority of those <br />present and a supplemental declaration along with a swearing-in of the officer making the
