• ! f <br /> .00 <br /> ORDINANCE No. 2700 <br /> AN ORDINANCE providing for the impr oveme nt of Colby <br /> Avenue from 26th Streetto Everett Avenue, by installation of <br /> a street lighting system, and doing all other work necessary <br /> to make a complete improvement , in accordance with a majority <br /> petition therefor , creating an assessment district, creating <br /> a local improvement district, creating a local improvement <br /> district fund therefor, providing for payment of said improve- <br /> ment by special assessments on the property in said district <br /> under the mode of payment by bonds. <br /> I REs:S , there has heretofore been filed with the <br /> City Council of the City of Everett a majority petition of the <br /> property owners on Colby Avenue from 26th Street to Everett <br /> Avenue, petitioning for the installation of an electric street <br /> lighting system; and <br /> WHEREAS , after due hearing on said petition it <br /> appears to the City Council that public convenience and <br /> necessity require that said improvement be made. <br /> NOW , T' REBQRE, The City of Everett does ordain: <br /> Section 1: That Colby Avenue from 26th Street to <br /> Everett Avenue be improved by the installation of an electric <br /> street lighting system, said system to inelnd e trenching , laying <br /> of cable , replacement of existing walks and driveways after <br /> trenching, laying conduit, installing posts and light units <br /> and all other material, and doing all other . ork necessary to <br /> make a complete improvement, all according to the plans and <br /> specifications prepared under the direction of the City <br /> Engineer, which plans and specificat ions are hereby adopted <br /> and approved. <br /> Section 2: That the cost and expense of such <br /> improvement, including all necessary incidental expenses, <br /> shall be borne by and assessed against the property included <br /> in the assessment district herein created in accordance with <br /> law. The City of Everett shall not lbe liable in any manner <br /> for any portion of the costs and expenses of such improvement , <br /> except as provided by Chapter 141, Session Laws of 1923, or <br /> acts amendatory thereto, and ordinances of the : ity of --.verett . <br /> Section 3; There is hereby established a local <br /> improvement district to be known as, Local Improvement District <br /> No. 519 , which district shall include the following <br /> described pr operty: <br /> Lots 1 to 15 inclusive, in Block 612 Sucker's <br /> First Addition to Everett ; <br /> Lots 18 to 32 inclusive, Block 613, Rucker ' s <br /> First Addition to Everett . <br /> Section 4: A special fund is hereby created to <br /> be called "Local Improvement District Fund No. 519 r which <br /> shall consist in the aggregate of the several amounts assessed, <br /> levied and collected on the several lots and parcels of land <br /> in said local improvement district, and the proceeds of the <br /> sale of the bonds of said district, for the purpose of de- <br /> fraying the co ate and expenses of such improvement .
