ORDINANCE NO. ________ <br />AN ORDINANCE PROVIDING FOR THE ACQUISITION BY EMINENT DOMAIN OF THE PROPERTY LOCATED <br />AT 1301 LOMBARD AVENUE, EVERETT, WASHINGTON, COMMONLY KNOWN AS THE WAITS MOTEL, <br />FOR THE PURPOSE OF ELIMINATING NEIGHBORHOOD BLIGHT <br />WHEREAS, <br />A.The City of Everett is a charter city, incorporated under the laws of the State of Washington, and <br />authorized to acquire title to real property for public purposes pursuant to Chapter 8.12 RCW. <br />B.RCW 35.80A.010 authorizes the City to condemn property that "constitutes a blight on the <br />surrounding neighborhood." RCW 35.80A.010 provides that a property is a "blight on the <br />surrounding neighborhood" if it meets “any two of the following factors: (1) If a dwelling, <br />building, or structure exists on the property, the dwelling, building, or structure has not been <br />lawfully occupied for a period of one year or more; (2) the property, dwelling, building, or <br />structure constitutes a threat to the public health, safety, or welfare as determined by the <br />executive authority of the county, city, or town, or the designee of the executive authority; or <br />(3) the property, dwelling, building, or structure is or has been associated with illegal drug <br />activity during the previous twelve months.” <br />C.RCW 35.80A.010 requires that, prior to such condemnation, the City Council shall adopt a <br />resolution declaring that the acquisition of the property is necessary to eliminate neighborhood <br />blight. <br />D.RCW 35.80A.010 provides that the condemnation of property for the purpose of eliminating <br />neighborhood blight is declared to be for a public use. <br />E.The real property commonly known as the Waits Motel is located at 1301 Lombard Ave., Everett, <br />Washington, Assessor's Parcel Number 29051700301400, with legal description as follows <br />ALL THAT PORTION OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 17, <br />TOWNSHIP 29 NORTH, RANGE 5 EAST, W.M., IN SNOHOMISH COUNTY, WASHINGTON, DESCRIBED AS <br />FOLLOWS; <br />BEGINNING AT THE QUARTER CORNER BETWEEN SECTIONS 17 AND 18 OF SAID TOWNSHIP AND RANGE; <br />THENCE EASTERLY ON CENTER LINE OF SAID SECTION 17, 966.57 FEET TO WEST LINE OF ALLEY BETWEEN <br />BROADWAY AND LOMBARD IN CITY OF EVERETT; <br />THENCE ANGLE RIGHT 90°36' FOR 28.39 FEET TO THE TRUE POINT OF BEGINNING; <br />THENCE CONTINUE ON SAME STRAIGHT LINE FOR 200 FEET; <br />THENCE ANGLE RIGHT 90°, 120 FEET; <br />THENCE ANGLE RIGHT 90°, 200 FEET; <br />THENCE ANGLE RIGHT 90°, 120 FEET TO THE TRUE POINT OF BEGINNING. <br />This real property, together with all improvements thereon, is referred to as the ‘Waits Motel” <br />in this Ordinance. <br />3964-23
