ORDINANCE NO. r'`' . <br /> An Ordinance requiring the contractor, E. J. Templeton & Co., to pro- <br /> vide a performance bond running to the city of Everett in the full amount <br /> of their contract for the making of the improvement upon 19th Street, Ever- <br /> ett, Washington, pursuant to Ordinance No. 2664, conditioned that said Uom- <br /> pany will perform all conditions of said contract and pay all laborers, <br /> mechanics, subcontractors or all persons performing labor upon such improve- <br /> ment and all materialmen furnishing supplies and materials in carrying on <br /> such work, and declaring an emergency. <br /> THE. CITY OF EVERETT DOES ORDAIN: <br /> Section 1. It shall be the duty of E. J. Templeton and M. J. Temple- <br /> ton, doing business under the name and style of the E. J. Templeton & Com- <br /> pany, before entering upon the performance of their contract with the city <br /> of Everett for the improvement of 19th Street , in the city of Everett, Sno- <br /> homish County, Washington, or before they shall do any work for the said ci- <br /> ty, to make , execute and deliver to the said City of Everett, a good and <br /> sufficient bond in a sum of not less than Sixty Thousand Eight Hundred Eighty- <br /> six and 6/100 ($60,886 .06) Dollars, with two or more sureties, or with a <br /> surety company as surety, conditioned that the said E. J. Templeton and M. J. <br /> Templeton, doing business under the name and style of E. J. Templeton & Com- <br /> pany shall faithfully perform all the provisions of such contract with the <br /> said city of Everett and shall pay all laborers, mechanics, subcontractors <br /> and materialmen and all persons who shall supply them or subcontractors, <br /> with provisions and supplies for the carrying on of the work in the improve- <br /> ment upon 19th Street, and that said bond shall be filed with the Clerk of <br /> said city of Everett, and that any person or persons performing any services <br /> or furnishing materials to them directly or to any subcontractor shall have <br /> the same right under the provisions of such bond as if such work, services <br /> or material was furnished to the original contractor. <br /> Section 2. That the aforesaid bond shall run to the said City of Ever- <br /> ett, and not to the State of Washington, and shall be made payable to the <br /> said city of Everett, and all such persons heretofore mentioned in paragraph <br /> one of this Ordinance shall have the right of action in his, her or their <br /> own name or names on such bond for work done by such laborers or mechanics, <br /> and for material furnished or provisions and goods supplied and furnished in <br /> -1- <br />
