ORDINANCE NO. 94 5-d. <br /> An Ordinance providing for the improvement of Oakes Avenue , in the City of <br /> Everett , from 13th Street to 16th Street, by grading to proper grade , construc- <br /> tion of cement curbs, construction of 6" Portland cement concrete pavement, thirty <br /> feet wide, installation of necessary drainage , making necessary water main changes , <br /> and doing all other work necessary in connection therewith, all in accordance with <br /> Resolution No . 3948 of the city of Everett, creating an assessment district , <br /> creating a local improvement district fund therefor, providing that said improve- <br /> ment be made by a special assessment not to exceed 55% of the cost thereof upon <br /> the property in said district under the mode of payment by bonds and the balance <br /> thereof by Federal grant to the said City. <br /> WHEREAS, by Resolution No. 3948 of the City of Everett the City Council has <br /> declared its intention to order the improvement as above outlined and doing all <br /> other work in connection therewith in accordance with the plans and specifica- <br /> tions prepared by the City Engineer, more than 500 of the abutting property own- <br /> ers having joined in a petition for such improvement ; Now, Therefore , <br /> TIE CITY CT EVERETT DOES ORDAIN: <br /> Section 1 . That the said Cakes Avenue , from 13th Street to 16th Street, be <br /> improved by grading to proper grade , construction of cement curbs, construction <br /> of 6" Portland cement concrete pavement , thirty (30) feet -wide , installation of <br /> necessary drainage, making necessary water main changes , and doing all other work <br /> necessary in connection therewith according to the plans and specifications pre- <br /> pared under the direction of the City Engineer, which plans and specifications <br /> are hereby approved and adopted. <br /> Section 2. That the cost and expense of such improvement, including all the <br /> necessary and incidental expenses, not to exceed fifty-five (55%) per cent plus <br /> clerk and treasurer's fees, shall be borne by and assessed against the property <br /> included in the assessment district created in accordance with law. The remain- <br /> ing amount not charged to the district shall be paid out of funds allocated to <br /> the city of Everett by Federal grant. The city of Everett shall not be liable <br /> in any manner for any portion of the costs and expenses of such improvement , ex- <br /> cept as provided in Chapter 141 , Session Laws of Washington, 1923, and ordinance <br /> No. 2126. of the city of Everett. <br /> Section 3. There is hereby established a local improvement district to be <br /> called. Local Improvement District No. 513 , which district shall include the <br /> following described property, to-wit; <br /> Lot Block Addition <br /> lf3 to 34 Inc. 248 14th Street Addition <br /> 1 to 17 Inc. 249 <br /> 1 to 7 Inc . 289 " " <br /> 7 to 16 Inc. 289 Hilton's 2nd Addition <br /> 26 to 32 Inc. 290 14th Street Addition <br /> -1- <br />
