• ORDINANCE NO . An Ordinance providing for the improvement of Broadway Avenue in the City of Everett, from Hewitt Avenue to Pacific Avenue , by removal of wood blocks, construction of one course Portland cement concrete pavement , now concrete curbs, repairing concrete curbs, repairing concrete sidewalk as found necessary, in- stallation of necessary drainage and doing all other work needful in connection therewith to make a complete improvement, all in accordance with Resolution No. 3958 of the city of Everett , creating an enlarged assessment district which shall be divided into a direct benefit district and an indirect benefit district, creating a local improvement district fund therefor, providing that the said im- provement be made by special assessment not to exceed thirty (30%) per cent, plus clerk and treasurer's fees, of the cost thereof upon property in the said district under the mode of payment by bonds and the balance by funds allocated from the Washington State Motor Vehicle fund and by Federal grant to the said. City. '::1REAS , by Resolution No. 3958 of the city of Everett the City Council has declared its intention to order the improvement as above outlined and doing all other work necessary in connection therewith to make a complete improvement in accordance with plans and specifications prepared by the City Engineer; Now, Therefore , THE CITY OF EVERETT DOES ORDAIN: Section 1 . That Broadway Avenue , from Hewitt Avenue to facific Avenue , be improved by the removal of old wood blocks , construction of one course Portland cement concrete pavement , new concrete curbs, repairing concrete curbs, repair- ing concrete sidewalks as found necessary, installation of necessary drainage and doing all other work needful in connection therewith to make a complete improve- ment according to the plans and specifications prepared under the direction of the City Engineer, whic}a plans and specifications are hereby approved and adopted . Section 2. That the cost and expense of such improvement , including all the necessary and incidental ,expenses, not to exceed thirty (30%) per cent plus clerk and treasurer's fees, shall be borne by and assessed against the property included in the enlarged assessment district - which shall be divided into a di- rect benefit district and an indirect benefit district - herein created in ac- cordance with law. The remaining amount not charged against the district shall be paid out of funds allocated to the city of Everett from the Washington State Motor Vehicle fund and by Federal grant. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, ex- cept as provided 'in Chapter 141, Session Laws of '~Washington, 1923, and Ordinance No. 2126 of the city of Everett . Section 3. There is hereby established an enlarged local improvement dis- trict to be called Local Improvement District No. ‘57j y , which said enlarged -1-
