Heating Company, a corporation, and assigned to its successor in in- <br /> terest, the Everett Steam l"eating Company, a corporation, under Ordin- <br /> ance t"o. 2543, published December 17th, 1931 , wherein the grantee was <br /> given the privilege of laying pipes and conduits in the streets, alleys <br /> and other public places in the City of Everett for the transmission of <br /> steam for heating and other purposes, with the right to collect reason- <br /> able tolls, rates and compensation for such service, subject to certain <br /> conditions, provisions and covenants performed and to be performed, <br /> is hereby declared forfeited by reason of default in the keeping of the <br /> said conditions , provisions and covenants in such. franchise contained, <br /> and all rights thereunder flowing to the }grantee or any of its successes <br /> or assigns shall be and the same is hereby terminated and there shall <br /> be a cessation and cancellation' of the remainder of the 25 year period <br /> of such franchise upon the taking effect of this ordinance. <br /> Section 2. That Ordinance o. 2543 and all other Ordinances in <br /> conflict herewith be and the same are hereby repealed. <br /> Section 3. This ordinance is necessary for the protection of the <br /> best interests of the City, for the support of government and its in- <br /> stitutions and shall take effect immediately upon its passage , and pub- <br /> lication. <br /> A.
