<br />DOL CDL Third Party Examiner 3 of 28 DOL K7951 <br />AG Rev June 2022 <br /> <br /> <br /> <br />This authorization agreement (hereinafter “Agreement”) is entered into by the State Washington, Department <br />of Licensing (hereinafter called "DOL"), and Everett Transit (hereinafter “Contractor”). DOL and Contractor may <br />be individually referred to as ‘party,’ or jointly referred to as ‘parties.’ <br /> <br />Pursuant to the mutual terms and conditions herein, the parties hereby agree as follows. <br /> <br />BACKGROUND INFORMATION <br />1. PURPOSE <br />It is the purpose of this Contract to authorize eligible third-party individuals or entities to facilitate the skills <br />testing of Washington’s commercial driver applicants seeking to receive a Commercial Driver’s License <br />(CDL) from DOL. This agreement establishes the terms, conditions, and requirements under which the <br />Contractor is authorized to be a Third Party Examiner (TPE) for such purposes. <br />This agreement also terminates, replaces, and/or supersedes any prior agreement of the parties allowing <br />Contractor to engage in third party testing. <br /> <br />2. AUTHORIZATION <br />This agreement is made pursuant to the authority granted in RCW 46.25.060(c), and 308-100-140 WAC, <br />which directly allow DOL to authorize the use of Third Party Examiner. The terms and conditions herein are <br />further consistent with 49 C.F.R. Sec.383.75. <br /> <br />3. DEFINITIONS <br />As used throughout this Contract, the following terms shall have the meanings set forth below: <br /> <br />a) “CDL Test Route” shall mean the areas for completing the pre-trip inspection, or safety inspections, <br />basic controls and road test, which is approved by DOL. <br /> <br />b) “CFR” shall mean the Code of Federal Regulations related to the “FMCSR” Federal Motor Carrier <br />Safety Regulations promulgated by the U.S. Department of Transportation. <br /> <br />c) “Conflict of Interest” shall mean a situation in which a person or organization is involved in multiple <br />interests, financial or otherwise, one of which could possibly corrupt the motivation or decision-making <br />of that individual or organization. <br /> <br />d) “Contractor” shall mean the person or entity performing Services under this Contract. <br /> <br />e) “Contract Manager” shall mean the representative identified in the text of this Contract who is <br />delegated the authority to administer this Contract. <br /> <br />f) “CSTIMS” shall mean the Commercial Skills Test Information Management System. <br /> <br />g) "Examiners’ Manual" means the Commercial Driver’s Examiners’ Manual promulgated by the state <br />of Washington, Department of Licensing. <br /> <br />h) “FMCSA” shall mean the Federal Motor Carrier Safety Administration. <br /> <br />i) “Invalidate Driver Test” shall mean the individual taking the test must retake the test, and at the <br />Applicant’s request the examiner must retest the applicant free of charge. <br /> <br />DocuSign Envelope ID: AC966A65-E68A-4258-A8B9-AE46FE8283C3
