ORDINANCE NO. ________ An ORDINANCE changing the Downtown Business Improvement Area (BIA) Budget, AMENDING Ordinance No. 3582-17, as amended WHEREAS, A.The City Council adopted Ordinance No. 3582-17, which established the Downtown Everett Business Improvement Area (BIA). The City Council later adopted Ordinance No. 3783-20 (amending Ordinance No. 3582-17), which extended the term of the Downtown Everett Business Improvement Area (BIA) for five years, modified the special assessment levy and boundaries, and approved a five-year budget, pursuant to Chapter 35.87A RCW. The City Council adopted in 2023 Ordinance No. 3936-24 (amending Ordinance Nos. 3582-17 and 3783-20), which adjusted assessments. B.Section 20 of Ordinance No. 3582-17 provides as follows regarding budget changes: Section 20. Changes in Budget. If the City Council finds that: (1) by reason of changed conditions or unanticipated circumstances, it is in the best interest of the participants in the BIA to provide changes to the approved budget; or (2) changes in the approved budget are necessary in order to best meet the objectives or purposes for which the BIA was formed; or (3) the total assessments collected are greater or less than anticipated, then the City Council may, by ordinance, amend the budget and reallocate the funding for the particular programs or services to be provided, and to provide funding for such other purposes as may be necessary, and determined by the City Council, to best serve the purposes for which the BIA was formed, in light of the conditions or unanticipated circumstances which then exist. C.The City Council adopted the current 2021-2025 budget in 2020 in Ordinance No. 3783-20. The City Council finds that total assessments have been greater than anticipated in 2020 and that changes in the approved budget are necessary. Accordingly, the City Council wishes to amend the 2021-2025 budget as set forth herein. 3965-23
