ORDINAL NO. 2633 <br /> An Ordinance relating to and providing for the issuance by the police judge <br /> of process and search warrants for the search and entry upon property, buildings, <br /> private dwelling houses or places of residences located in the City of Everett, <br /> upon complaint showing probable cause and in the enforcement of the ordinances <br /> of said city, repealing all ordinances and parts of ordinances in conflict here- <br /> with and declaring an emergency. <br /> THE CITY OF 37EM T DOES ORDAIN: <br /> Section 1. It shall be lawful for the police judge of the City of sverett, <br /> in addition to his powers as a justice of the peace , to aid in the more effectual <br /> enforcement of the ordinances of the said city, to issue process and search war- <br /> rants which shall be directed to the :`Washington State 3atrol Officers, or the She- <br /> riff of Snohomish County and his Deputies, Chief of Police of the City of :lverett <br /> or any police officer thereof, or either or any of them. . <br /> Section 2. A search warrant shall not be issued but upon probable cause, <br /> supported by affidavit , naming or describing the person or persons charged with <br /> crime and particularly describing the property and the place to be searched . <br /> Section 3 . The police judge issuing the warrant must , before issuing the <br /> same, examine on oath the complainant and any witness he may produce, and require <br /> their affidavits or take their depositions in writing and cause them to be sub- <br /> scribed by the parties making them. Such affidavits or depositions must set forth <br /> facts tending to establish the grounds of the application or probable cause for <br /> believing that they exist,. <br /> Section 4. If the police judge is thereupon satisfied of the existence of <br /> the grounds of the application, or that there is probable cause to believe their <br /> existence , he shall issue a search warrant signed by him with his name of office , <br /> directed to a civil officer of the State of ':Washington duly authorized to enforce <br /> or assist in enforcing any laws thereof, which warrant must state the particular <br /> grounds or the probable cause for its issue and the names of the persons whose <br /> affidavitx have been taken in support thereof, and commanding said officer forth- <br /> with to search the person or place named , for the property specified, and to bring <br /> the same before the police judge . <br /> Section 5. The officer may break open any olyter or inner door or window of <br /> a house or any part of a house , or building, or anything therein, to execute the <br /> warrant, if, after notice of his authority and purpose , he is refused admittance, <br /> -1- <br />
