ORDINANCE NO. 2632. An Ordinance granting a partial release of easement by the city of Everett to the State of Washington for a right of way over and across the NE4 of the iiI*;4 of Section 28 and the Niof the lin-, and NW of NE of Section 27, all in Town- ship 29 North, Range 5 E.'W. ;• . , Snohomish County, :ashington, in the location and improvement of State Road No. 15, Everett to Cavelero's Corner Section. THE CITY OF EVERETT DOES HEREBY ORDAIN: Section 1. That the City of Everett hereby grants and surrenders a partial release of easement to the State of Washington for a right of way in the location and improvement of State Road No. 15, Everett to Cavelero' s Corner, Snohomish County, Washington, and agrees that the said City shall be bound by each and all of the terms and conditions of said grant, which grant is in words and figures as follows: "PARTIAL RELEASE OF EASE ENT" "KNOW ALL MEN BY THESE PRESENTS, that the city of Everett, a municipal cor- poration, being the owner of a perpetual easement for a 100 foot right of way for a pipe line, or lines, over and across the NE4 NE4, Section 28; N- -NV , Nn 4-NE4, Section 27, ail in Township 29 North, Range 5 East W.M. "And Whereas, the State of Washington, in the location and improvement of State Road No. 15, Everett to Cavelero's Corner Section, has purchased a right of way over and across said above described tracts of land; "NOW TIEREFORE, the city of Everett, in consideration of the benefits and the sum of One ($1.00) Dollar, in hand paid, receipt whereof is hereby acknowledged, do hereby RELEASE from said right of way easement and bargain, grant and sell all right, title and interest it may have to that portion of land in above described tracts of land as shown in red color on the attached blue print map, which is made a part hereof, to the STATE OF WASHINGTON forever, without in any way affect- ing the pipe line of grantor on said premises. "It is understood and agreed that the city of Everett shall have the right to encroach upon any of the right of way herein released that is not used by the State of Washington for highway purposes for the purpose of constructing and maintaining additional pipe line or lines. "IN WITNESS WHEREOF , the city of Everett, a municipal corporation, by Ordinance; i'o. 2632 has hereby executed, sealed and delivered this partial release of ease- ment on this 9th day of January , A.D. 193_1.
