purposes, and not for pecuniary gain. <br /> (x) "Restaurant" means any establishment provided with special space and <br /> accommodations where , in consideration of payment, food, without lodgings, is ha- <br /> bitually furnished to the public, not including drug stores and soda fountains. <br /> (y) "Soda Fountain" means a place especially equipped with apparatus for <br /> the purpose of dispensing soft drinks, whether mixed or otherwise . <br /> (z) "Tavern" means any establishment with special space and accommodation <br /> for sale by the glass and for consumption on the premises, of beer, as herein de- <br /> fined. <br /> Section 3. LIQUORS EXEMPTED. Nothing in this ordinance shall apply to wine <br /> or beer manufactured in any home for consumption therein, but not for sale ; nor <br /> to any liquor in the possession of any person, kept for personal use but not for <br /> sale , at the effective date of the Washington State Liquor Act; nor shall this <br /> ordinance be construed as limiting the right of any minister, priest, or rabbi, <br /> or religious organization from obtaining wine for sacremental purposes directly <br /> from any source whatsoever, whether from within the limits of the State of Wash- <br /> ington or from outside of the state; nor to any liquor or preparations exempted <br /> under the Washington State Liquor Act. <br /> Section 4. UNLAdFUL POSSESSION OF LIQUOR. No liquor shall be kept or had <br /> within the City of Everett, unless the package in which the liquor was contained <br /> had, while containing that liquor, been sealed with the official seal prescribed <br /> under the Washington State Liquor Act , except in the case of: <br /> (a) Liquor imported by the state liquor control board; or <br /> (b) Liquor manufactured in the City of Everett for sale to the liquor con- <br /> trol board or for export; or <br /> (c) Beer purchased in accordance with the provisions of the Washington <br /> State Liquor Act; or <br /> (d) Wine , beer or liquor exempted in Section 3 hereof. <br /> Section 5. LIQUOR NOT TO BE CONSUMED IN PUBLIC PLACE . Except as permitted <br /> by the Washington State Liquor Act , no person shall open the package containing <br /> liquor or consume liquor in a public place . Every person who violates any provi- <br /> sion of this section shall be guilty of a violation of this ordinance, and, on <br /> conviction thereof, shall be fined not more than Ten Dollars ($10); for a second <br /> -4- <br />
