COMMERCIAL LEASE <br /> THIS COMMERCIAL LEASE (the "Lease"), made to be effective this Sf day of <br /> t-eMb-V, 20 72-(the "Effective Date"), by and between LJR Plaza, LLC, a Washington <br /> limited liability company ("Lessor"), and *******, an individual ("Lessee"). <br /> 1. Lease. Subject to the conditions set forth herein, Lessor does hereby lease to <br /> Lessee and Lessee does hereby lease from the Lessor the "Premises," as described below. <br /> The Premises are commonly known as Unit 9605E, LJR Plaza, located at 9605 Evergreen <br /> Way, Everett, Washington 98204, and are a part of a commercial building ("the <br /> Building'). The Building contains other tenant units. The Building is located on the <br /> "Real Property" described in Exhibit A attached to this Lease. The site plan for the <br /> existing building now located on the Real Property together with the suite plan for Unit <br /> 9605E is attached as Exhibit B to this Lease. <br /> 2. Description of Premises. The Building is identified on the site plan attached <br /> as Exhibit B. The Premises consist of that certain portion of the Building designated as <br /> the "Premises" in Exhibit B. The Premises consist of approximately 1,600 square feet of <br /> floor area. The Premises is bounded by the: center of all interior demising walls; interior <br /> surface of all exterior perimeter walls; upper surface of the structural floor; and lower <br /> surface of the suspended ceiling. The Premises do not include the roof or any exterior <br /> surfaces of any of the walls enclosing the Premises. <br /> 3. Purpose and Exclusive Right. The Premises shall be used for a restaurant <br /> and any necessary incidental uses. Lessee shall obtain and maintain all necessary <br /> approvals from all applicable government authorities to occupy the Premises for Lessee's <br /> ded use. <br /> 4. Common Areas. The Lessor does also hereby grant to the Lessee, the <br /> Lessee's employees, agents, contractors and invitees the nonexclusive right, in common <br /> with the Lessor, other tenants of the Lessor and their respective employees, agents, <br /> contractors and invitees, to use the Common Areas and Common Facilities within the <br /> Real Property. The Common Areas consist generally of all those improved portions <br /> ("Improvements") of the Real Property, which are not occupied by buildings or other <br /> structures, and are intended for the common use of tenants of the Real Property. The <br /> Common Areas will consist generally of parking areas, driveways, trash enclosures, <br /> sidewalks and landscaping. The Lessor reserves the right to: <br /> i. Reconfigure, make or permit changes, additions or revisions to the <br /> Real Property including the buildings, walkways, driveways, parking areas and <br /> Common Areas; and <br /> ii. Construct improvements within the Real Property and make <br /> alterations or additions to all improvements, including the buildings, within the <br />
