CLASS ACTION WAIVER ADDENDUM <br />This document is an Addendum and is part of the Rental/Lease agreement, dated August 23, 2023 between The <br />Verge(Owner/Agent) and Trevor Ryan, Tyler Ottesen, Elizabeth Hagan and Mike Letourneau (Resident) for the premises <br />located at 511A, 511B, 511C, 513A, 513B, 513C at 2420 Airport Road, Ellensburg, WA 98926. <br />ADDENDUM. This Addendum constitutes an Addendum to the above described Lease Contract for the above described premises. <br />Where the terms or conditions found in this Addendum vary or contradic t any terms or conditions found in the Lease Contract, this <br />Addendum shall control. <br />CLASS ACTION WAIVER. You agree that you hereby waive your ability to participate either as a class representative or member <br />of any class action claim(s) against us or our agents. While you are not waiving any right(s) to pursue claims against us related to <br />your tenancy, you hereby agree to file any claim(s) against us in your individual capacity, and you may not be a class action plaintiff, <br />class representative, or member in any purported class action lawsuit (“Class Action”), Accordingly, you expressly waive any right <br />and/or ability to bring, represent, join, or otherwise maintain a Class Action or similar proceeding against us or our agents <br />in any forum. <br />Any claim that all or any part of this Class Action waiver provision is unenforceable, unconscionable, void, or voidable <br />shall be determined solely by a court of competent jurisdiction. <br />YOU UNDERSTAND THAT, WITHOUT THIS WAIVER, YOU MAY HAVE POSSESSED THE ABILITY TO BE A PARTY TO A <br />CLASS ACTION LAWSUIT. BY SIGNING THIS AGREEMENT, YOU UNDERSTAND AND CHOOSE TO WAIVE SUCH ABILITY <br />AND CHOOSE TO HAVE ANY CLAIMS DECIDED INDIVIDUALLY. THIS CLASS ACTION WAIVER SHALL SURVIVE THE <br />TERMINATION OR EXPIRATION OF THIS LEASE CONTRACT. <br />SAVINGS AND SEVERABILITY. If any clause or provision of this Rental Agreement is illegal, invalid or unenforceable under <br />present or future laws effective during the term, then it is the intention of the parties hereto that the remainder of this R ental <br />Agreement shall not be affected hereby, and it is also the intention of the parties to this Rental Agreement that in lieu of each clause <br />or provision that is illegal, invalid or unenforceable, there be added as a part of this Rental Agreement a clause or provision similar <br />in terms to such illegal invalid or unenforceable clause or provision as may be possible and be legal, valid and enforceable. <br />City of Everett ____________________________________ Date: August 23, 2023 <br />Owner Representative _________________________________ Date: August 23, 2023
