Current code provisions for <br /> non-residential uses requires parking be located on-site or on property within 500'of the use in the "same zone as, or a <br /> zone which allows,the use for which the parking is required."The issue in this instance is that the parking lot property is <br /> zoned R-2, which is a different zone than the subject property and the R-2 zone prohibits food/beverage establishments. <br /> I know that parking lot has been there for some time but further research is necessary to determine when the parking <br /> lot was created, if it was legally established, and required processing (if any)to transfer that over to the requested <br /> change of use. I will work on this upon my return to the office.
