+r a <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above, it is hereby concluded that the <br /> Respondent is responsible for correcting violations of IPMC 106.1 and IRC R105.1 on the <br /> subject property and is hereby ordered as follows: <br /> 1. The Respondent must abate all violations of IPMC 106.1 and IRC R105.1 on property <br /> located at 1929 Virginia Avenue, Everett, Washington. • <br /> 2. Abatement shall include the following: • <br /> a. The entire residential structure located on the subject property shall remain vacant and <br /> secured from trespass until occupancy is approved by the City of Everett Building <br /> Division. <br /> b. The Respondent shall apply for and obtain all of the necessary and required permits to <br /> bring the property into compliance with City ordinances. The Respondent shall have the <br /> work inspected and approved by the City of Everett Building Division by October 22, <br /> 2021. <br /> c. Any violations not listed in this Order are subject to standard enforcement processes and <br /> procedures. <br /> 3. The Respondent shall be fined $500.00 for violations of IPMC 106.1 and IRC R105.1. The <br /> entire fine shall be suspended provided the Respondent comply with items 2a-2b of this <br /> Order by October 22, 2021. If compliance has not been met by October 22, 2021 or if same <br /> or similar violations occur on the subject property within 24 months,then the suspended fine <br /> shall be immediately due to the City. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC 1.20.020 or any ordinance <br /> or regulation that identifies the enforcement procedure described in EMC Chapter 1.20 as <br /> the procedure for said regulations or ordinance, for the next twenty-four(24)months. <br /> 5. This written Order shall be controlling over any conflicts with oral Orders issued at the <br /> Public Hearing. <br /> 6. If the Respondent fails to abate the identified violations as directed by this Order,the City of <br /> Everett is authorized to undertake and complete the abatement in conformance with the <br /> provisions of the Everett Municipal Code, Chapter 1.20, at the full expense of the owner, <br /> which shall be in addition to the fines as imposed herein. The City may act without further <br /> order or direction of the Violations Hearing Examiner. <br /> 7. Any post hearing motions shall comply with the Rules of Procedure of the City of Everett <br /> Hearing Examiner for Code Enforcement which can be found on the City of Everett website. <br /> ,5 � (A <br />
