The Fair Housing Act, Title VII-IX of the Civil Rights Act of 1968 (42 USC § <br />3601 et seq.), which prohibits discrimination in housing on the basis of race, <br />color, national origin, sex, familial status, or disability; <br /> <br />3. Section 504 of the Rehabilitation Act of 1973, as amended (29 USC § 794), <br />which prohibits discrimination on the basis of handicap under any program <br />or activity receiving or benefitting from federal assistance; <br /> <br />4. The Age Discrimination Act of 1975, as amended (42 USC § 6101 et seq.) <br />and Treasury’s implementing regulations at 31 CFR Part 23, which prohibit <br />discrimination on the basis or age in programs or activities receiving federal <br />financial assistance; and <br /> <br />5. The American with Disabilities Act of 1990, as amended (42 USC 12101 et <br />seq.), which prohibits discrimination on the basis of disability under <br />programs, activities and services provided or made available by state and <br />local governments or instrumentalities or agencies thereto. <br /> <br />6. The Agency shall include the above clauses 1-5, adapted for the proper <br />parties, in any subcontract, subject to the terms and conditions of Exhibit A. <br /> <br />F. Conflicts <br /> <br />The Agency’s employees, subcontractors and board or committee members <br />shall not use, or give the appearance of using, their positions for the personal <br />gain of themselves or those with whom they have family, business or other ties. <br />The Agency understands and agrees it must maintain a conflict of interest <br />policy consistent with 2 CFR § 200.318(c). The Agency shall disclose to the <br />County any potential conflict of interest affecting the awarded funds in <br />accordance with 2 CFR § 200.112. <br /> <br />The Agency shall include the above clause, adapted for the proper parties, in <br />any subcontract, subject to the terms and conditions of Exhibit A. <br /> <br />G. Public Records <br /> <br />In addition to complying with the Public Records provisions in Section III.C of <br />the Agreement, the Agency acknowledges that by accepting funds under this <br />Agreement, it may be considered the functional equivalent of a public agency <br />under the Public Records Act, chapter 42.56 RCW. <br /> <br />H. Capacity <br /> <br />The Agency, by signing this Agreement, acknowledges that it has the <br />institutional, managerial, and financial capability to ensure proper planning, <br />management, and provision of the services funded.
