South Correctional Entity (SCORE) <br />Housing Agreement <br />Page 13 <br />Exhibit C <br />PREA ACKNOWLEDGMENT - CUSTODIAL AND SEXUAL MISCONDUCT <br />1.Compliance <br />SCORE agrees to ensure that all of its employees, contractors, vendors, and volunteers that have <br />contact with Contract Agency Inmates comply with all federal and state laws regarding sexual <br />misconduct including, but not limited to: <br />a)The Prison Rape Elimination Act of 2003 (PREA) <br />b)The standards for adult Prisons and Jails or Community Confinement Facilities, whichever is <br />applicable, as promulgated by the US Attorney, and <br />c)Zero tolerance toward all forms of sexual abuse and sexual harassment. <br />2.Monitoring <br />SCORE agrees to provide the Contract Agency documented compliance with the Federal Prison <br />Rape Elimination Act standards. Monitoring may include, but is not limited to: <br />a)Site visits, <br />b)Access to facility data, and <br />c)Review of applicable documentation. <br />3.Contract Agency may terminate this Agreement <br />a)Should SCORE fail to provide documentation that demonstrates that the SCORE is <br />actively and effectively working toward and is making substantive progress toward <br />achieving compliance; or <br />b)Should SCORE fail to maintain PREA compliance between auditing periods, after being <br />given a reasonable opportunity to cure. <br />4.The Contract Agency will terminate this Agreement <br />a)Should SCORE elect to discontinue pursuit of PREA compliance; <br />b)Should SCORE be found in noncompliance through a PREA Audit and fail to cure such <br />noncompliance within the identified timeframes; or <br />c)Should SCORE be found to be in egregious violation of PREA.
