CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 86 <br />Include hot mix asphalt, recycled concrete aggregate, recycled glass, steel furnace slag <br />and other recycled materials (e.g. utilization of on-site material and aggregates from <br />concrete returned to the supplier). Contractor shall provide report on DOT form 350- <br />075A Recycled Materials Reporting. <br />1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC <br />1-07.1 Laws to be Observed <br /> 1-07.1(1) General <br /> Revise 1-07.1(1) by replacing the second sentence of the first paragraph with the <br />following: <br />The Contractor shall indemnify, defend, and save harmless the City (including its agents, <br />officers, and employees) against any claims that may arise because the Contractor (or <br />any employee of the Contractor or Subcontractor or material person) violated a legal <br />requirement. <br /> <br /> 1-07.1(2) Health and Safety <br />Supplement 1-07.1(2) by adding the following: <br />The Contractor shall be in compliance at all times with all COVID-19 Requirements <br />applicable to the Work.Contractor’s Bid includes all costs necessary for the duration of the <br />Work for compliance with Baseline COVID-19 Requirements.. <br /> <br />Supplement 1-07.1by adding the following: <br />1-07.1(6) Additional Requirements <br />The Contractor shall be in compliance with all applicable standards, orders, or <br />requirements issued under Section 306 of the Clean Air Act [42 U.S.C. 1857(h)], Section <br />508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental <br />Protection Agency Regulations (40 CFR Part 15). (Contracts, subcontracts, and <br />subgrants of amounts in excess of $100,000). <br />The Contractor shall comply with mandatory standards and policies relating to energy <br />efficiency that are contained in the state energy conservation plan issued in compliance <br />with the Energy Policy and Conservation Act (Pub. L. 94-163). <br />The City advises all general contractors and subcontractors that numerous Federal, <br />State, and Local regulations exist that could affect the procedures used in the completion <br />of this project. The City advises each prospective Contractor that they are responsible <br />to be aware of and comply with all applicable statutes and regulations. It is <br />recommended that each Contractor contact the local office of the following agencies for <br />a list of applicable regulations and requirements that might affect the implementation of <br />this project: <br />· Federal Environmental Protection Agency <br />· Washington Department of Health <br />· Washington Department of Ecology <br />· Washington Department of Fisheries <br />· Washington Department of Wildlife <br />· Washington Department of Labor & Industries <br />· Puget Sound Air Pollution Control Agency <br />· Municipal Building Department <br />· Municipal Planning Department <br />· Municipal Public Works Department
