APPLICATION AND AGREEMENT FOR STEAM SERVICE

<br /> hereinafter called the CONSUMER, hereby asks the CITY STEAM HEATING COMPANY, hereinafter called the COM-
<br /> PANY, to furnish Steam Service for the period ending
<br /> to the premises at the above address and occupied as for the following equipment:
<br /> Building Radiation Water Heating
<br /> Kitchen Fixtures Open Taps •
<br /> The COMPANY agrees to furnish all steam required by the CONSUMER at the above premises and to make all rea-
<br /> sonable provisions to insure satisfactory continuous service, but does not guarantee a constant supply, and shall not be
<br /> liable for failure to supply continuous service.
<br /> The COMPANY reserves the right to refuse or to discontinue service to any equipment or piping system which does
<br /> not permit the free metering of any or all steam supplied to it, or which is in any way faulty, defective or dangerous.
<br /> The CONSUMER agrees to take and pay for steam furnished in rendering steam service hereunder as measured at and
<br /> by themeter, or meters, of the COMPANY on the above premises, or elsewhere, or on a flat rate basis in the case of open
<br /> taps, in accordance with the COMPANY'S regular schedule of rates as follows:

<br /> (1) All bills for service hereunder are to be paid at the office of the COMPANY within ten (10) days from date of bill.
<br /> If default in payment shall at any time be made by the CONSUMER, then the COMPANY shall have the right at its option,
<br /> in addition to all other rights and remedies at law or equity, to cancel or terminate this agreement or to discontinue the de-
<br /> livery of steam without cancelling or terminating this agreem ent, until all moneys due to it shall have been paid. This
<br /> option may be exercised by the COMPANY whenever and as often as such default shall occur, and neither delay nor
<br /> omission on the part of the COMPANY to exercise such option at any time shall be deemed a waiver of its right to ex-
<br /> ercise same.
<br /> (2) The COMPANY may install on the premises of the CONSUMER or elsewhere as agreed, a meter, or meters, for
<br /> the measurement of the CONSUMER'S consumption of steam, and from the readings thereof all bills shall be calculated
<br /> and proper records kept upon the books of the COMPANY. Should the meter, or meters, fail to register correctly, the con-
<br /> sumption shall be estimated, basing the amount charged upon previous consumption.
<br /> (3) All meters, piping and other appliances installed by the COMPANY shall remain the property of the COMPANY.
<br /> All piping and equipment between the service valve and the meter or meters, also the discharge piping from the same,
<br /> shall be installed by the CONSUMER at his expense and in such manner that the COMPANY may conveniently perform
<br /> its part of this agreement, and shall be kept and maintained in condition satisfactory to the COMPANY by the CON-
<br /> SUMER at his expense.
<br /> (4) The steam of the COMPANY is to be used for all low pressure steam equipment during the term of this agree-
<br /> ment, and no changes in or additions to the equipment listed herein are to be made by the CONSUMER until five (5)
<br /> days notice in writing shall have been given to the COMPANY, so that the COMPANY may change its meter or meters, if
<br /> necessary, and make such changes in its equipment as the new conditions demand.
<br /> (5) The COMPANY is hereby granted all rights of way and easements over the property of the CONSUMER, necessary
<br /> or convenient for the erection, maintenance, repair, replacement or use of any or all piping, machinery, apparatus and fix-
<br /> tures necessary or convenient for the supplying and delivery of steam hereunder by the COMPANY, and also the right to
<br /> free access at reasonable times to said premises, for the purpose of inspecting the equipment, removing the property of the
<br /> COMPANY, reading meters and doing such other things as are incidental to the carrying out of this agreement.
<br /> (6) The COMPANY does not assume the duty of inspecting the CONSUMER'S piping and equipment and shall not be
<br /> responsible therefor; the use of said steam upon the premises of the CONSUMER is at the risk of the CONSUMER, and
<br /> the liability of the COMPANY shall cease at the point of delivery of steam to the piping or equipment of the CONSUMER.
<br /> (7) The CONSUMER is to prevent all leaks, permit no open taps, except by special arrangement, to report promptly
<br /> to the COMPANY any waste in the steam piping or equipment and, upon request of the COMPANY, to immediately repair
<br /> any leaky or defective piping or equipment.
<br /> This agreement may be terminated by the CONSUMER or the COMPANY at the end of the period herein provided for
<br /> service, or at the end of any yearly period thereafter by written notice at least thirty (30) days in advance of such ter-
<br /> mination; if not so terminated, this agreement shall continue in full force, and the COMPANY shall continue to furnish ser-
<br /> vice and the CONSUMER to pay for the same according to the terms hereof. This agreement supersedes all others.
<br /> This agreement is binding upon the COMPANY only when approved by a duly authorized agent of the COMPANY.
