CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 56 <br />1-02.10 Withdrawing, Revising, or Supplementing Proposal <br />Delete 1-02.10 and substitute with the following: <br />After submitting a physical Proposal to the City, the Bidder may withdraw, revise, or <br />supplement its Proposal if: <br />1. The Bidder submits a written request signed by an authorized person and <br />physically delivers it to the place designated for receipt of Proposals, and <br />2. The City receives the request before the time set for receipt of Bid Proposals, and <br />3. The revised or supplemented Proposal (if any) is received by the City before the <br />time set for receipt of Proposals. <br />The original physical Bid Proposal may be supplemented, or revised and resubmitted as <br />the official Proposal if the City receives it before the time set for receipt of Proposals. If <br />the Bidder does not submit a revised or supplemented package in time, then its bid shall <br />be considered withdrawn. <br />Email, fax or telephone requests to withdraw, revise, or supplement a Proposal are not <br />acceptable. <br />Resubmitted Proposals shall be in full compliance with the bidding requirements. Bid <br />deposit shall be in an amount sufficient for the Proposal as resubmitted. <br />After the scheduled time for opening Proposals, no Bidder will be permitted to withdraw <br />Bidder’s Proposal unless the award of contract is delayed for a period exceeding 45 <br />calendar days. Proposals received after the scheduled closing for opening Proposals <br />will be returned unopened to the Bidder. <br />1-02.12 Public Opening of Proposals <br />Supplement 1-02.12 by adding the following: <br />1-02.12(1) Postponement of Opening <br />(******) <br />The City reserves the right to postpone the date and time for receiving or opening of <br />Bids, or both, at any time prior to the date and time established in the Notice to Bidders. <br />Postponement notices shall be provided to Bidders in the form of addenda. <br />Supplement 1-02.12 by adding the following: <br />1-02.12(2) Video Conferencing <br />(******) <br />The City reserves the right to open and publicly read Bids by use of video-conferencing, <br />such as by Microsoft Teams, Zoom or other application. <br /> <br />1-02.13 Irregular Proposals <br />Revise item 1 and 2 of 1-02.13 to read as follows: <br />(e) 1. A Proposal will be considered irregular and will be rejected if: <br />a.. The authorized proposal form furnished by the City is not used or is altered; <br />b. The completed proposal form contains any unauthorized additions, deletions, <br />alternate Bids, or conditions; <br />c. The Bidder adds provisions reserving the right to reject or accept the Award, <br />or enter into the Contract; <br />d. A price per unit cannot be determined from the Bid Proposal; <br />e. The Proposal form is not properly executed; <br />f. The Bidder fails to submit or properly complete, on the form provided by the <br />City, the Subcontractor list, if applicable, as required in 1-02.6;
