CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 72 <br />constitute a waiver of the Contract requirements. The City will not be obligated to accept <br />or pay for Work performed by the Contractor that may be affected by materials, <br />Equipment, or methods of work not submitted in a timely manner so that final review can <br />be accomplished before the affected Work is complete. The City shall not be responsible <br />for Delays, inefficiencies, or any additional costs or expenses caused in whole or in part <br />by Contractor’s failure to submit required information in sufficient time for review, <br />comment, and correction. Contractor’s failure to submit required information in sufficient <br />time for review, comment and correction shall be deemed a waiver of any and all <br />Contract Claims for adjustment of Contract Sum or Contract Time arising out of, or <br />related to, such a Submittal. Contractor acknowledges and agrees that it may not rely <br />upon receiving the City’s response to a Submittal in less than 14 calendar days, unless <br />the City explicitly changes this section by a signed Change Order. <br />1-05.3(2) Requests for Information <br />(******) <br />Requests for information or clarification from the Contractor to the City shall be treated <br />as a Submittal pursuant to 1-05.3(1) SUBMITTALS. <br />1-05.4 Conformity With and Deviations From Plans and Stakes <br />Delete all of 1-05.4 and substitute the following: <br />The Contractor shall be responsible for setting and maintaining all alignment stakes, <br />slope stakes, and grades necessary for the construction of the roadbed, surfacing, <br />paving, channelization, illumination, signing, bridges, and retaining walls, if such <br />construction is included in this Project. Except for the survey control data to be furnished <br />by the City, calculations, surveying, and measuring required for setting and maintaining <br />the necessary lines and grades shall be the Contractor's responsibility. The Contractor <br />shall provide the City with copies of such calculations and staking data when requested <br />by the Engineer. Copies of the City provided survey control data are available for the <br />Bidder's inspection at the office of the Project Engineer. <br />Any staking requirements for the Project that do not fit field conditions will be reviewed <br />and if necessary adjusted by the Engineer. Any necessary revisions to the staking <br />information will be provided to the Contractor for use in completing the Work. <br />Stakes, marks, and other reference points, including existing monumentation, set by the <br />City shall be carefully preserved by the Contractor. The Contractor will be charged for <br />the costs of replacing stakes, markers and monumentation that were not to be disturbed <br />but were destroyed or damaged by the Contractor's operations. This charge will be <br />deducted from monies due or to become due to the Contractor. <br />To facilitate the establishment of these lines and elevations, the City will provide the <br />Contractor with the following survey control: <br />ROADWAY, SURFACING AND PAVING <br />Establish elevation bench marks and center or base line alignment control <br />points for the mainline, one time only. Provide right of way stakes where <br />applicable. <br />Provide rights-of-way, easements or right-of-entry. <br />Provide the Contractor with technical advice if requested. <br />Computed grades where needed. <br />Provide horizontal and vertical curve data. <br />One copy of transit notes showing reference to horizontal and vertical control <br />points. <br />OTHER STRUCTURES
