7 <br /> <br />ISU = Impervious Surface Unit, defined as 2500 sf of impervious surface area. <br /> <br />* “Impervious surface,”, “stormwater,” “stormwater drainage system,” and <br />“receiving water body or receiving waters” as defined in chapter 14.28 EMC. <br /> <br />Section 6. The preamble subsection of EMC 14.08.135 (which preamble states in its entirety “In <br />addition to current sewer and water connection permit and inspection fees, there is hereby imposed, on <br />the owners of properties, a special connection charge in the following amounts:”) is deleted: <br /> <br /> <br />Section 7. EMC 14.08.135.I is amended as follows: <br /> <br />I. Impervious surface or area is defined by chapter 14.28 EMC. <br /> <br />Section 8. Sections of this Ordinance are to be codified as follows: <br /> <br />This Ordinance <br />Section <br />EMC Subsection <br />2 14.08.135.A <br />3 14.08.135.B <br />4 14.08.135.C <br />5 14.08.135.D <br /> <br />The current EMC 14.08.135A-D are Sections 1 through 4 of Ordinance 3632-18. Those four ordinance <br />sections contain charges for time periods prior to January 1, 2024. Although those four ordinance <br />sections in Ordinance 3632-18 are not repealed, their codification is no longer necessary. <br /> <br />Section 9. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br />corrections to this Ordinance including, but not limited to, the correction of scrivener’s/clerical errors, <br />references, ordinance numbering, section/subsection numbers, and any internal references. <br /> <br />Section 10. The City Council hereby declares that should any section, paragraph, sentence, clause or <br />phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br />would have passed all portions of this ordinance independent of the elimination of any such portion as <br />may be declared invalid. <br />Section 11. The enactment of this Ordinance shall not affect any case, proceeding, appeal or other <br />matter currently pending in any court or in any way modify any right or liability, civil or criminal, which <br />may be in existence on the effective date of this Ordinance. <br /> <br />Section 12. It is expressly the purpose of this Ordinance to provide for and promote the health, safety <br />and welfare of the general public and not to create or otherwise establish or designate any particular <br />class or group of persons who will or should be especially protected or benefited by the terms of this <br />Ordinance. It is the specific intent of this Ordinance that no provision or any term used in this Ordinance
