Grand from Pacific to 32nd St, by grading and construction of a six-inch one course Portland cement concrete pavement, and doing all other work necessary to moalre a complete improvement, creating an assessment district, creating a local improvement district fund therefor, and providing that payment for said improvement be made by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, a majority petition of the property owners petitioning for said improvement, has heretofore bean filed with the Commissioner of Public Works and said. Commissioner has found the things set forth in said petition to be true, and WHEREAS, said. Commissioner of Public Works has filed with the City Council all data and information, as required by law, and, WAREAS, said. Commissioner of Public Works has recommended to the City Council that said improvement petitioned far be made, and it appearing to the City Council that public convenience and necessity requires such improvement to be made; now, therefore, THE CITY OF EVERETT DOES ORDAIN: the Section 1: That/alley between Rucker and Grand from Pacific to 32nd St. be improved by grading and construction of a six-ihoh one course Portland cement concrete pavement, and doing all other work necessary to make a complete improvement, according to the plans and specifications, prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: hat the cost and expense of such improvement, in- cluding all necessary incidental expanses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement , except as provided in Chapter 141, Session Laws of 1923, and Ordinance No. 2126 of the City of Everett. Section 3: There is hereby established int a local improvement district, to be called. Local Improvement District No. 506 which district shall include the following described property: Lots 1 to 32, inclusive, Block 734, Plat of Everett Division H. Section 4: A special fund is hereby created to be called Local Improvement District Fund No. 506 , which shall consist in the aggregate of the several amounts assessed, _levied and collected on the several lots and parcels of land in said local improvement district, and the proceeds of the sale of the bonds of said district, for the purptase of defraying the costs and expenses of such improve- ment. Out of said fund shall be paid the bonds, the interest thereon and the entire cost of such improvement. Section 5: , The costs and expenses of such improvement shall be defrayed by special assessments, payable in ten (10 ) equal Annual installments, with interest thereon at the, rate of-arii4ea'( 70) per cent per annum, under the mode of payment by bonds, as provided by law and th Ordipances of this city.
