GENERAL INFORMATION <br />1.1 DEFINITIONS OF WORDS AND TERMS <br />Where used in the Contract Documents, the following words and terms shall have the meanings indicated. <br />The meanings shall be applicable to the singular, plural, masculine and feminine of all words and terms. <br />Addenda: Written or graphic instruments issued prior to the opening of Bids that clarify, correct, or <br />change the Bidding Requirements or the proposed Contract Documents. <br />Additive: A supplemental unit of work or group of bid items, identified separately in the Bid Form, that <br />may, at the discretion of the City, be awarded in addition to the base Bid. <br />Alternative or Alternate: One of two or more units of Work or groups of bid items, identified separately <br />in the Bid Form, from which the City may make a choice between different methods or material of <br />construction for performing the same Work. <br />Application for Payment: Form acceptable to Owner that Contractor is to use during the course of the <br />Work in requesting progress or final payments that is to be accompanied by such supporting <br />documentation as is required by the Contract Documents. <br />Architect: An individual or entity retained by the Owner to be the Owner’s representative with regard to <br />matters of design intent. The terms “Owner’s Representative”, “Engineer” and “Architect” are <br />interchangeable. <br />Award Date: The date of the formal action by the Everett City Council to accept the lowest responsible <br />and responsive Bidder for the Work. <br />Bid: The offer or proposal of a bidder submitted on the prescribed form setting forth the prices for the <br />Work to be performed. <br />Bid Form – The form provided to Bidders by the City for submittal of a Proposal or Bid to the City for a <br />specific project. <br />Bidder: An individual, partnership, firm, corporation, or joint venture, submitting a Bid. <br />Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br />Call for Bids (Advertisement for Bids): The published public notice soliciting or Bids for Work stating, <br />among other things, the time, place, and date for receiving and opening the Bids. <br />Change Order: Reference to Change Order shall include all rights of the Owner and Contractor under <br />ARTICLE 6. CHANGES. <br />Completion Date: Date on which Project is ready for Final Acceptance. All physical Work, including <br />Punch List, is complete and Contractor has completed and fulfilled all contractual obligations except any <br />maintenance of landscaping. Contractual obligations that must be fulfilled prior to achievement of the <br />Completion Date include, but are not limited to, the Contractor’s furnishing all documentation (including <br />correct, complete and accurate as-built or record drawings) and operation and maintenance manuals and <br />transfer of warranties. <br />Contract: Agreement signed by the Owner and Contractor (Section 005213). Depending on context, <br />“Contract” may also refer to the Contract Documents as a whole. Contract Documents are defined in <br />section 1.2 below. <br />Contract Claim: Any request by the Contractor for additional time or money (adjustment of Contract <br />Sum or Contract Time) irrespective of the cause or reason for the request. Contract Claims include, but <br />are not limited to, requests by the Contractor for additional time or money due to Extra Work, <br />inefficiencies, Delays, interferences, and problems with the design. Contract Claim includes, but is not <br />limited to, claims or requests by Subcontractors for extensions of Contract Time, adjustment of Contract
