B. Notwithstanding any provision herein, the Fire Department shall have <br /> the discretion of requesting a specific agency or company when it is deemed to be in <br /> the best interests of the patient or the City. <br /> SECTION 16: Training. <br /> A. AH training of persons in the City for emergency medical care, except as <br /> provided in accredited medical programs, shall be reviewed by the Medical Director. <br /> Certification of instructors for emergency medical care shall be done in the manner and <br /> method as determined by the Department of Health Office of EMS/Trauma Systems. <br /> B. All persons who intend to teach, instruct or otherwise train persons who <br /> are working within the City in emergency medical care shall be approved by the <br /> Medical Director. <br /> SECTION 17: Penalties. <br /> A. Any person violating or failing to comply with any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor. The fine may not exceed One <br /> Thousand Dollars ($1,000) or imprisonment in jail for a term not exceeding ninety (90) <br /> days or both such fine and imprisonment. <br /> B. Each day that any violation of, or failure to comply with this ordinance, <br /> shall constitute a separate and distinct offense under this section and shall be <br /> punishable as such hereunder; provided, however, that the Court may, in appropriate <br /> cases stay the accumulation of penalties. <br /> SECTION 18: Severability. <br /> If any one or more of the provisions, sections, covenants or agreements provided in <br /> this ordinance to be performed by the City shall be declared by any court of competent <br /> jurisdiction to the contrary to law, then such provision, section, covenant or agreement <br /> shall be null and void and shall be deemed separable from the remaining provisions, <br /> sections, covenants or agreements in this ordinance and shall in no way affect the <br /> validity of the other provisions of this ordinance. <br /> SECTION 19: General Duty <br /> It is expressly the purpose of this ordinance to provide for and promote the health, <br /> safety and welfare of the general public and not to create or otherwise establish or <br /> designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this ordinance. <br /> jmc/ems/cntrcts/amblnce 12 <br />
