• �'w 2�06 -0�3 <br />April 17, 2020 <br />Tony Lee <br />Building Official <br />City of Everett Public Works <br />3200 Cedar Street <br />Everett, WA 98201 <br />Dear Mr. Lee: <br />C L A R K <br />BARNES <br />cltarkbarnes.com <br />4)1 fit: <br />This letter is intended to formally request that Everett OZ Developer LLC be allowed to <br />submit the excavation and shoring permit application for the project located at 2701 <br />Rockefeller Avenue, Everett prior to approval by the Planning Department of the SEPA <br />and/or Land Use Application submitted on February 28t", 2020. <br />We acknowledge to the City, that Everett OZ Developer LLC understands the risks <br />associated with submitting the excavation and shoring permit application prior to approval <br />of the SEPA and/or Land Use and further understands that submitting for a building permit <br />does not vest the project or imply that land use approvals will be given. <br />Finally, Everett OZ Developer LLC agrees to hold the City of Everett harmless for the loss of <br />paid application fees, design fees, and other fees that may be incurred if the SEPA and/or <br />Land Use comments cause the project to be altogether denied, affects the timeframe that <br />creates a feasibility issue related to the project or requires additional design modifications <br />subsequent to submittal of the building permit. <br />Sincerely, <br />Trent Mummery <br />Manager <br />Everett OZ Developer LLC <br />
