CITY OF EVERETT - CITYWIDE BICYCLE WAYFINDING <br />STATE FUND# HLP-PB21(014) <br />WO#3786 September 25, 2023 <br /> 7 <br /> 1 <br />After submitting a physical Bid Proposal to the Contracting Agency, the Bidder may 2 <br />withdraw, revise, or supplement it if: 3 <br /> 4 <br />1. The Bidder submits a written request signed by an authorized person and 5 <br />physically delivers it to the place designated for receipt of Bid Proposals, and 6 <br />2. The Contracting Agency receives the request before the time set for receipt of 7 <br />Bid Proposals, and 8 <br />3. The revised or supplemented Bid Proposal (if any) is received by the Contracting 9 <br />Agency before the time set for receipt of Bid Proposals. 10 <br /> 11 <br />If the Bidder’s request to withdraw, revise, or supplement its Bid Proposal is received 12 <br />before the time set for receipt of Bid Proposals, the Contracting Agency will return the 13 <br />unopened Proposal package to the Bidder. The Bidder must then submit the revised or 14 <br />supplemented package in its entirety. If the Bidder does not submit a revised or 15 <br />supplemented package, then its bid shall be considered withdrawn. 16 <br /> 17 <br />Late revised or supplemented Bid Proposals or late withdrawal requests will be date 18 <br />recorded by the Contracting Agency and returned unopened. Mailed, emailed, or faxed 19 <br />requests to withdraw, revise, or supplement a Bid Proposal are not acceptable. 20 <br /> 21 <br />1-02.13.RTF 22 <br />1-02.13 Irregular Proposals 23 <br />(December 30, 2022 APWA GSP) 24 <br /> 25 <br />Delete this section and replace it with the following: 26 <br /> 27 <br />1. A Proposal will be considered irregular and will be rejected if: 28 <br />a. The Bidder is not prequalified when so required; 29 <br />b. The authorized Proposal form furnished by the Contracting Agency is not used 30 <br />or is altered; 31 <br />c. The completed Proposal form contains any unauthorized additions, deletions, 32 <br />alternate Bids, or conditions; 33 <br />d. The Bidder adds provisions reserving the right to reject or accept the award, or 34 <br />enter into the Contract; 35 <br />e. A price per unit cannot be determined from the Bid Proposal; 36 <br />f. The Proposal form is not properly executed; 37 <br />g. The Bidder fails to submit or properly complete a subcontractor list (WSDOT 38 <br />Form 271-015), if applicable, as required in Section 1-02.6; 39 <br />h. The Bidder fails to submit or properly complete a Disadvantaged Business 40 <br />Enterprise Certification (WSDOT Form 272-056), if applicable, as required in 41 <br />Section 1-02.6; 42 <br />i. The Bidder fails to submit Written Confirmations (WSDOT Form 422-031) from 43 <br />each DBE firm listed on the Bidder’s completed DBE Utilization Certification 44 <br />that they are in agreement with the bidder’s DBE participation commitment, if 45 <br />applicable, as required in Section 1-02.6, or if the written confirmation that is 46 <br />submitted fails to meet the requirements of the Special Provisions; 47 <br />j. The Bidder fails to submit DBE Good Faith Effort documentation, if applicable, 48 <br />as required in Section 1-02.6, or if the documentation that is submitted fails to 49 <br />demonstrate that a Good Faith Effort to meet the Condition of Award was made; 50
