CITY OF EVERETT - CITYWIDE BICYCLE WAYFINDING <br />STATE FUND# HLP-PB21(014) <br />WO#3786 September 25, 2023 <br /> 49 <br />The Contracting Agency and the Contractor mutually agree to be bound by the decision of 1 <br />the arbitrator, and judgment upon the award rendered by the arbitrator may be entered in 2 <br />the Superior Court of the county in which the Contracting Agency’s headquarters is 3 <br />located, provided that where claims subject to arbitration are asserted against a county, 4 <br />RCW 36.01.050 shall control venue and jurisdiction of the Superior Court. The decision of 5 <br />the arbitrator and the specific basis for the decision shall be in writing. The arbitrator shall 6 <br />use the Contract as a basis for decisions. 7 <br /> 8 <br /> 9 <br />1-10.GR1 10 <br />1-10 TEMPORARY TRAFFIC CONTROL 11 <br /> 12 <br />1-10.2.GR1 13 <br />1-10.2 Traffic Control Management 14 <br /> 15 <br />1-10.2.INST1.GR1 16 <br />Section 1-10.2 is supplemented with the following: 17 <br /> 18 <br />1-10.2.OPT1.GR1 19 <br />(November 2, 2022) 20 <br />Work Zone Safety Contingency 21 <br />Enhancements to improve the effectiveness of the accepted traffic control plans to 22 <br />increase the safety of the work zones shall be discussed on a weekly basis between the 23 <br />Contractor and the Contracting Agency. Enhancements shall be mutually agreed upon by 24 <br />the Contractor and Engineer prior to performing any Work to implement the enhancement. 25 <br /> 26 <br />Enhancements do not include the use of Uniformed Police Officers or WSP, address 27 <br />changes to the allowed work hour restrictions, or changes to the staging plans in the 28 <br />Contract (if applicable).
