<br /> <br /> <br />2 <br />C. Business Associate. <br />“Business Associate” means Peak1 Administration, LLC, dba Peak One Administration. <br />D. Confidential Personal Information. <br />“Confidential Personal Information” will mean an Individual’s first name or first initial and last name in <br />combination with any one or more of the following items, if the name and the items are not encrypted: a) <br />social security number; driver’s license number or government-issued identification number; or account <br />number or credit or debit card number in combination with any required security code, access code, or <br />password that would permit access to an Individual’s financial account; or b) information that identifies an <br />Individual and relates to: the physical or mental health or condition of the Individual; the provision of health <br />care to the Individual; or payment for the provision of health care to the Individual. <br />E. Covered Entity. <br /> “Covered Entity” means City of Everett <br />F. Designated Record Set or DRS. <br />“Designated Record Set” or “DRS” will have the meaning given to such term under the HIPAA Rules, including, <br />but not limited to, 45 CFR §164.501.B. <br />G. Electronic Protected Health Information or PHI. <br />“Electronic Protected Health Information or PHI” will have the meaning in the Security Rule, 45 CFR § 160.103. <br />H. HIPAA Rules. <br />“HIPAA Rules” means the Privacy, Security, Breach Notification and Enforcement Rules 45 CFR 160 and <br />164. <br />I. Information. <br />“Information” will mean any “health information” as defined in 45 CFR §160.103. <br />J. Individual. <br />“Individual” will mean the person who is the subject of the PHI and will include a person who qualifies as a <br />personal representative in accordance with 45 CFR § 164.502(g). <br />K. National Provider Identifier. <br />“National Provider Identifier” refers to the rules under 45 CFR Part 162 that require HIPAA covered entities to <br />utilize a ten digit identifier in PHI related transactions. <br />L. Protected Health Information or PHI. <br />“Protected Health Information or PHI” means “protected health information” as defined in 45 CFR § 160.103 <br />that is used, disclosed, transmitted or maintained in any form.
