The City may require Grantor to restore or otherwise remedy any missing or <br /> damaged equipment or facilities installed pursuant to the TDM plan to the satisfaction of the City. <br /> • The City may enforce compliance with the TDM plan through mechanisms available to the City <br /> including but not limited to enforcement pursuant to chapter 1.20 EMC, injunctive relief,monetary <br /> penalties, and loss of units available for rental. <br /> • The Property may not be substantially remodeled or the use expanded or changed, without first <br /> obtaining development permit(s) from the City. The City will evaluate the proposed remodel. <br /> expansion or change of use to determine consistency with the approved TDM plan and will make <br /> one of the following determinations: <br /> • The proposed remodel expansion or change of use is consistent with prior project approval and <br /> TDM and has no impact on demand for off-street parking. <br /> • The proposed remodel. expansion or change of use results in the requirement for additional off- <br /> street parking and an amendment to the approved TDM plan is required. No development <br /> permits will be issued until such time as said amendment(s) have been reviewed and approved by <br /> the City. <br /> • The proposed remodel, expansion or change of use results in a reduced demand for parking and <br /> the need for a TDM plan no longer exists. The City will, at the applicant's request, extinguish <br /> this covenant and issue a determination that the TDM plan is no longer applicable. <br /> • Records. The Grantor will keep any records and make any reports relating to compliance with this <br /> covenant that Grantee may reasonably require. <br /> This covenant touches and concerns the Property and shall run with the land and is for the benefit of the <br /> general public and shall be binding upon the Grantor's heirs, devisees, executors, administrators, successors <br /> and assigns.
