October 28, 2021 <br />VIA USPS PRIORTY MAIL <br />City of Everett Permit Services <br />3200 Cedar Street, 2nd Floor <br />Everett, WA 98201 <br />Re: Verizon Wireless Building Permit Application B2109-008 <br />1871 Ross Avenue, Everett, WA <br />Status of 60-Day Eligible Facilities Request Application <br />To Whom It May Concern: <br />We write to you regarding the status of the above -referenced building permit application <br />submitted on September 2, 2021 (the "Application"). Please note that the equipment <br />modification described in the Application qualifies as an Eligible Facilities Request to <br />modify an existing wireless facility, and therefore must be approved under 47 U.S.C. § <br />1455 (the "Spectrum Act"). <br />The Spectrum Act was intended to provide streamlined approval by localities of certain <br />modifications to existing wireless facilities by requiring that "a State or local government <br />may not deny, and shall approve, any eligible facilities request for a modification of an <br />existing wireless tower or base station that does not substantially change the physical <br />dimensions of such tower or base station." 47 U.S.C. § 1455(a). A municipality's <br />application review process is therefore limited to determining whether the proposed <br />modification is an eligible facilities request that does not substantially change the <br />physical dimensions of the tower or base station. 47 C.F.R. § 1.61001(c). The review must <br />be completed and approval issued within sixty (60) days of submission.
