Please note that the equipment modification described in the Application qualifies as an Eligible Facilities Request to modify an existing wireless facility, and therefore must be approved under 47 U.S.C. § 1455 (the "Spectrum Act"). The Spectrum Act was intended to provide streamlined approval by localities of certain modifications to existing wireless facilities by requiring that "a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." 47 U.S.C. § 1455(a). A municipality's application review process is therefore limited to determining whether the proposed modification is an eligible facilities request that does not substantially change the physical dimensions of the tower or base station. 47 C.F.R. § 1.61001(c). The review must be completed and approval issued within sixty (60) days of submission. Id. Verizon respectfully requests that the City of Everett continue to process the Application consistent with the requirements of the Spectrum Act. As the sixty 60-day shot clock is almost expired, please advise as to the status of the City's review of the Application and whether there are any outstanding questions or concerns Verizon can assist with resolving.
