equipment already deployed on the ground. The current boundaries of a site are the boundaries that existed as of <br />the date that the original support structure or a modification to that structure w as last review ad and approved by a <br />State or local government, if the approval of the m odification occurred prior to the Spectrum Act or otherw be <br />outside of the section 6409(a) process. <br />(7) Substantial change. A modification substantially changes the physical dimensions of an eligible support structure if <br />it meets any of the follow hg criteria: <br />(i) For tow ss other than tow e-s in the public rights-of-w at, it increases the height of the tow a by m ore than 10% <br />or by the height of one additional antenna array w th separation from the nearest existing antenna not to <br />exceed tw E,ty feet, w hchever is greater; for other eligible support structures, it increases the height of the <br />structure by m ore than 10% or m ore than ten feet, w hchever is greater; <br />(A) Changes in height should be measured from the original support structure in cases w here deployments <br />are or w II be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in <br />height should be m easured from the dim ensions of the tow a or base station, inclusive of originally <br />approved appurtenances and any m odifications that w se approved prior to the passage of the Spectrum <br />Act. <br />(ii) For tow ss other than tow e-s in the public rights-of-w af, it involves adding an appurtenance to the body of the <br />tow Er that w cold protrude from the edge of the tow a m ore than tw eity feet, or m ore than the w dth of the <br />tow a structure at the level of the appurtenance, w hchever is greater; for other eligible support structures, it <br />involves adding an appurtenance to the body of the structure that w cold protrude from the edge of the <br />structure by more than six feet; <br />(iii) For any eligible support structure, it involves installation of more than the standard number of new equipment <br />cabinets for the technology involved, but not to exceed four cabinets; or, for tow as in the public rights-of-w at <br />and base stations, it involves installation of any new equipment cabinets on the ground if there are no pre- <br />existing ground cabinets associated w th the structure, or else involves installation of ground cabinets that are <br />m ore than 10% larger in height or overall volum ethan any other ground cabinets associated w th the structure; <br />(iv) It entails any excavation or deployment outside of the current site, except that, for tow as other than tow as in <br />the public rights-of-w qr, it entails any excavation or deployment of transmission equipment outside of the <br />current site by more than 30 feet in any direction. The site boundary from w hch the 30 feet is measured <br />excludes any access or utility easements currently related to the site; <br />(v) It w aild defeat the concealment elements of the eligible support structure; or <br />(vi) It does not com ply w th conditions associated w th the siting approval of the construction or modification of <br />the eligible support structure or base station equipment, provided how aver that this lim itation does not apply <br />to any modification that is non-com pliant only in a m anner that w cold not exceed the thresholds identified in § <br />1.40001(b)(7)(i) through (iv). <br />(8) Transm fission equipm ent. Equipm ent that facilitates transm ission for any Com m ssion-licensed or authorized <br />w reless com m Lnication service, including, but not lim ited to, radio transceivers, antennas, coaxial or fiber-optic <br />cable, and regular and backup pow a supply. The term includes equipm ent associated w th w reless <br />com m uiications services including, but not lim ited to, private, broadcast, and public safety services, as w dl as <br />unlicensed w reless services and fixed w 'reless services such as m icrow ate backhaul. <br />(9) Tower. Any structure built for the sole or prim ary purpose of supporting any Com mssion-licensed or authorized <br />antennas and their associated facilities, including structures that are constructed for w reless com m uiications <br />services including, but not lim ited to, private, broadcast, and public safety services, as w dl as unlicensed wireless <br />services and fixed w reless services such as m icrow ate backhaul, and the associated site. <br />(c) Review of applications. A State or local government may not deny and shall approve any eligible facilities request for <br />modification of an eligible support structure that does not substantially change the physical dimensions of such <br />structure. <br />(1) Docum Entation requirem Ent for review. W hen an applicant asserts in w iting that a request for m odification is <br />covered by this section, a State or local government may require the applicant to provide documentation or <br />inform ation only to the extent reasonably related to determ ring w Nether the request m eets the requirem ents of this <br />section. A State or local governm ent m ay not require an applicant to subm it any other docum entation, including but <br />not lim ited to documentation intended to illustrate the need for such w reless facilities or to justify the business <br />decision to modify such w reless facilities. <br />
