The uncovered and damaged condition of vehicles parked on unimproved surfaces, and which are <br /> exposed to rainfall, poses a water quality risk that contaminants may discharge to groundwater to which <br /> a stormwater system discharges, in violation of Everett Municipal Code(EMC) 14.28.140,which reads: <br /> • EMC 14.28.140 Illicit discharges and connections. <br /> A. Prohibited Discharges. No person shall throw, drain,or otherwise discharge,cause or allow <br /> others under its control to throw,drain or otherwise discharge into the storm drainage system <br /> or any receiving waters any materials other than stormwater. Illicit discharges are prohibited <br /> and constitute a violation of this chapter. Examples of prohibited materials include, but are not <br /> limited to,the following: <br /> 1. Trash or debris. <br /> *** <br /> 3. Petroleum products including but not limited to oil,gasoline,grease,fuel oil and heating oil. <br /> 4. Antifreeze and other automotive products. <br /> 5. Metals in either particulate or dissolved form. <br /> *** <br /> 28. Chemicals not normally found in uncontaminated water. <br /> *** <br /> 30. Any hazardous material or waste not listed above. <br /> *** <br /> The presence of personal and/or household items,buckets,junk,salvage materials and vehicle parts <br /> that are visible from other properties are violations of Everett Municipal Code(EMC)8.20.020 A,C, &G, <br /> which read: <br /> • EMC 8.20.020 Nuisances—Residential property and nonresidential property. <br /> Except as authorized by subsection H of this section or as may be allowed by another city <br /> ordinance, no person owning, leasing, renting,occupying or having charge or possession of any <br /> property in the city, including vacant lots,shall maintain or allow to be maintained on the <br /> property outside of a fully enclosed structure such as a shed, dwelling,or closeable garage, any <br /> of the following conditions visible from any street,alley,or other public or private property: <br /> A. Junk,trash, litter, boxes,discarded lumber,salvage materials or other similar materials; <br /> *** <br /> C. Broken or discarded furniture, household equipment and furnishings; <br /> *** <br /> G. Vehicle parts or other articles of personal property which are discarded or left in a state of <br /> partial construction or repair; <br /> *** <br /> CORRECTIVE ACTIONS REQUIRED: By 10/30/2023,the Responsible Person(s)shall take the following actions <br /> to correct the Code Violations at the Property: <br /> 1. Any inoperable vehicles must be removed from the property,or made operable to include <br /> current license,or they may be lawfully enclosed. Inoperable vehicle(s) may be stored inside a <br /> garage,or they may be covered by an opaque auto cover specifically designed to completely <br /> shield the vehicle from view.The cover must be in good condition and must be replaced if it is <br /> torn,weather-beaten,or acquires any other defects.Tarps and makeshift covers do not meet <br /> the requirement. <br /> Notice and Order Page 3 of 6 <br />
