y/ ORDINANCE NO. <436 . An Ordinance providing for the improvement of 16th Street, from Baker Avenue to 'walnut Avenue, by the installation of water mains, and doing all other work necessary to make a complete improve- ment, creating an assessment district, creating a local improve- ment District fund therefor, and providing that payment for said improvement be made by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, a majority petition of the property owners peti- tioning for said improvement has heretofore been filed with the Commissioner of Public Works and said Commissioner has found the things set forth in said petition to be true; and WHEREAS, said Commissioner of Pu lic corks has filed with the City Council all data and information, as required by law; and WHEREAS, said Commissioner of Public `forks has recommend- ed to the City Council that said improvement petitioned for be made, and it appearing to the City Council that public convenience and necessity requires such improvement to be made; now, therefore, THE CITY OF EVERETT DOES ORDAIN: Section 1: That 16th Street, from Baker to walnut Avenues, be improved by the installation of water mains, and doing all other work necessary to make a complete improvement, according to the plans and specifications prepared under the direction of the City .engineer, which plans and specifications are hereby adopted aid ap- proved. Section 2: That the cost and expense of such improvement, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The city of Everett shall not be liable in any manner for any portion of the costs and expen- ses of such improvement, except as provided in Chapter 141, Session Laws of 1923 and Ordinance No. 2126 of the City of Everett.
