rnek-77- <br /> ORDINANCE NO. 2315-98 <br /> AN ORDINANCE relating to purchase or consumption of liquor by an intoxicated <br /> person, adding a new section to Everett Municipal Code Chapter 10.42 -Liquor <br /> Offenses. <br /> WHEREAS, the 1998 Washington State Legislature added a new civil infraction <br /> prohibiting an apparently intoxicated person from purchasing or consuming liquor; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Code to be <br /> in conformity with state law in this area. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: A new section is hereby added to Everett Municipal Code, Chapter 10.42 - <br /> Liquor Offenses, to read as follows: <br /> Purchase or Consumption of Liquor by Intoxicated Person. <br /> A. No person who is apparently under the influence of liquor may purchase or <br /> consume liquor on any premises licensed by the Washington State Liquor Control Board. <br /> B. A violation of this section is a civil infraction punishable by a fine of not more than <br /> five hundred dollars. <br /> C. A defendant's intoxication may not be used as a defense in an action under this <br /> section. <br /> Section 2: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City <br /> of Everett hereby declares that it would have adopted this ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one <br /> or more sections, subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br />
