MLE 325-178 Subrecipient Agreement - Boating Program (FFA Grant Award) Page 4 of 35 <br />SECTION 7: RESPONSIBILITIES OF EACH PARTY <br />7.1 Responsibilities of Subrecipient: <br />This project itself is the sole responsibility of Subrecipient. MLE undertakes no <br />responsibilities to Subrecipient, or to any third party, other than as expressly set out in this <br />document. Subrecipient shall be solely responsible for the design, development, <br />implementation, achievement of deliverables and reporting of the project, as those phases <br />are applicable to this project, and solely responsible for any claim or suit of any nature by <br />any third party related in any way to the project. <br />7.1.1 Project Timeline. The Subrecipient is responsible for maintaining the project timeline for <br />all dates and activities outlined as the Subrecipient’s responsibility as identified in the <br />Subrecipient’s FFA Grant Application (Attachment “A”). <br />The Subrecipient shall complete the approved project no later than September 30, 2024, <br />as a term of the acceptance of this grant award. The project timeline cannot be extended <br />under the scope of this agreement. <br />MLE staff shall monitor the activities conducted under the scope of this project on a <br />quarterly basis. Work will be considered complete, only when the following conditions are <br />met: <br />•The activities described in the Scope of Work and this grant document have been <br />achieved. <br />•All request for reimbursements have been submitted. <br />•All reporting through the MLE Statement of Activity Reporting system (SOAR) and <br />SECTOR have been completed <br />•Appropriate proof of completion has been provided to MLE <br />If the work is not satisfactorily completed, Subrecipient will be in breach and MLE may, at <br />its discretion, rescind the grant and require repayment of any grant funds already <br />disbursed. <br />7.1.2 Design Preparation. The Subrecipient shall design a project that will have a reasonably <br />likelihood of positively impacting the reduction of boating accidents, boating injuries, and <br />boating fatalities. Such design shall include applicable items on the Checklist for Plans <br />and Specifications as provided in the Subrecipient’s MLE Grant Application (Attachment <br />“A”). <br />7.1.3 Purchase. The Subrecipient shall make no purchases in excess of $2,500.00 without <br />prior written authorization by MLE. All purchases must be in the furtherance of <br />recreational boating safety and must adhere to the guidelines set out in the in the <br />Allowable Costs and Expenditures for State Vessel Registration Fees and Federal <br />Assistance Grants manual. (Attachment “B”). <br />7.1.4 Periodic Inspections. Subrecipient hereby grants to the Recipient, or its authorized <br />representative, a right, equal in time to six years from the date of the last signature on this <br />document, to enter upon Subrecipient's property as deemed necessary by the Recipient <br />for inspection documents and any equipment.
