10.111° <br /> ORDINANCE NO. 2318-98 <br /> AN ORDINANCE relating to drug paraphernalia, adding a new section to Everett <br /> Municipal Code Chapter 10.35 -Drug Paraphernalia and Marijuana. <br /> WHEREAS, the 1998 Washington State Legislature added a new civil infraction of selling or <br /> giving drug paraphernalia to another person, under circumstances where it cannot be proven that <br /> the person selling or giving the drug paraphernalia knows, or reasonably should know, that it <br /> would be used for an unlawful purpose; and <br /> WHEREAS,the City of Everett City Council deems it appropriate for the Everett City Code to be <br /> consistent with state law in this area. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: A new section is hereby added to Everett Municipal Code Chapter 10.35 -Drug <br /> Paraphernalia and Marijuana, to read as follows: <br /> A. Every person who sells or gives, or permits to be sold or given to any person any drug <br /> paraphernalia in any form commits a civil infraction punishable by a fine of not more than five <br /> hundred dollars. <br /> B. For purposes of this section, "drug paraphernalia" means all equipment, products, and <br /> materials of any kind which are used, intended for use, or designed for use in planting, <br /> propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, <br /> producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, <br /> concealing, injecting, ingesting, inhaling, or otherwise introducing into the human body a <br /> controlled substance. Drug paraphernalia includes, but is not limited to objects used, intended for <br /> use, or designed for use in ingesting, inhaling, or otherwise introducing marihuana, cocaine, <br /> hashish, or hashish oil into the human body, such as: <br /> 1. Metal, wooden, acrylic, glass, stone, plastic, or ceramic pipe with or without screens, <br /> permanent screens, hashish heads, or punctured metal bowls; <br /> 2. Water pipes; <br /> 3. Carburetion tubes and devices; <br />
