LPD MOS 22.3.5 <br />Page 1 of 3 <br />City of Lakewood <br />EQUIPMENT LOAN AGREEMENT <br />This agreement is made and entered into this 16th day of January 2024, by and <br />between the City of Lakewood (“City”) and Everett Police Department (“EPD”). <br />WHEREAS, the City owns a vehicle that is suitable for police use as a “bait car” to <br />help apprehend vehicle thieves; and <br />WHEREAS, the EPD would benefit from the use of a “bait car” to apprehend vehicle <br />thieves in the City of Everett; and <br />WHEREAS, City is willing to loan the “bait car” to the EPD without cost; <br />NOW, THEREFORE, the parties agree as follows: <br />1.SCOPE OF PERFORMANCE. <br />The City shall provide the EPD with a vehicle suitable for the purpose of “bait car.” <br />(a)Description of Vehicle: <br />Kia Sorento outfitted with four in-car cameras, remote disable <br />capabilities, and GPS tracking. <br />(b)Use of the “bait car” is limited to cases handled by the EPD. <br />2.CONTRACT TERM. <br />The term of performance of the Contract shall be from January 16, 2024 until <br />either February 23, 2024 at 11:59 PM or upon EPD delivering the bait car back to the <br />City’s custody and control, whichever occurs earlier. <br />Either party may terminate this Agreement for any reason and at any time when, in <br />its sole discretion, it is in the best interest of the terminating party by giving ten (10) days <br />prior written notice to the other party. The “bait car” is to be returned to the City upon either <br />termination or expiration of this agreement, whichever first occurs. <br />COMPENSATION. <br />There is no compensation to be paid by the EPD to the City for the use of the “bait <br />car.” The EPD shall be responsible for any and all costs of operation and routine maintenance <br />of the “bait car” including fuel and routine maintenance such as oil changes. Such expenses <br />shall be borne by the EPD and paid directly to providers as such costs accrue. EPD shall <br />return the “bait car” in substantially the same condition as it came to EPD, and shall be <br />responsible for the costs of repair or replacement for any damage accrued to the “bait car” <br />during the term of this agreement. <br />-------as of the
