ti 0 <br /> #°1e/‘11P <br /> vi4411$1' 174111 <br /> ORDINANCE NO. 2323-98 <br /> AN ORDINANCE providing for the vacation of a portion <br /> of the unopened 106th Street S.E. right of way lying South of Lots <br /> 17-20, Block 2, Plat of Silver Lake Garden Tracts, located West of <br /> 19th Avenue S.E. and West of 16th Avenue S.E.., Everett WA. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 4579 duly <br /> adopt and fix the 29th day of April, 1998 at 8:30A.M., as the date of public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner prescribed by <br /> law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds it would not vacate the alley could it not insure that <br /> traffic circulation would be continued through an alternate right of way; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said right <br /> of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described rights-of-way: <br /> That portion of the dedicated 20 foot wide right of way, known as 106th Street <br /> S.E.,adjoining the south boundaries of Lots 17 through 20 inclusive in Block 2, <br /> Plat of Silver Lake Garden Tracts, according to the plat thereof, recorded in <br /> Volume 8 of Plats, page 17, records of Snohomish County, Washington, <br /> LESS the westerly 30 feet thereof, as measured along the south line of said Lot <br /> 17. <br /> be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. <br />
