ti 0 #°1e/‘11P vi4411$1' 174111 ORDINANCE NO. 2323-98 AN ORDINANCE providing for the vacation of a portion of the unopened 106th Street S.E. right of way lying South of Lots 17-20, Block 2, Plat of Silver Lake Garden Tracts, located West of 19th Avenue S.E. and West of 16th Avenue S.E.., Everett WA. WHEREAS, the City Council of the City of Everett, did by Resolution No. 4579 duly adopt and fix the 29th day of April, 1998 at 8:30A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; and WHEREAS, the City Council finds it would not vacate the alley could it not insure that traffic circulation would be continued through an alternate right of way; and WHEREAS, it now appears to the City Council of the City of Everett that the said right of way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described rights-of-way: That portion of the dedicated 20 foot wide right of way, known as 106th Street S.E.,adjoining the south boundaries of Lots 17 through 20 inclusive in Block 2, Plat of Silver Lake Garden Tracts, according to the plat thereof, recorded in Volume 8 of Plats, page 17, records of Snohomish County, Washington, LESS the westerly 30 feet thereof, as measured along the south line of said Lot 17. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
