subsequent six month renewal periods by later adoption. Through the adoption of Ordinance No. 2210-97, the City provided for a second six month renewal period. Ordinance No. 2138-96, as amended by Ordinance No. 2145-96, Ordinance No. 2173-96, Ordinance No. 2210-97, Ordinance No. 2245-97 and Ordinance No. 2280-98, is hereby amended and the City hereby adopts a fifth six(6) month renewal period in order to prevent the moratorium adopted in Ordinance No. 2138- 96 from in any way terminating or otherwise lapsing. Section 2: Fifth Renewal Period. Ordinance No. 2138-96 is hereby amended by the addition of the following section: Notwithstanding any language in this ordinance, this ordinance shall not terminate or otherwise lapse. This ordinance is hereby renewed and extended for a fifth additional six (6) month renewal period. During this period, the work plan implemented during the first, second, third and fourth six (6) month extensions to the moratorium shall continue to be implemented through the monitoring of the litigation and defending the challenges concerning the City's adult use policy and_regulatory strategy. Section 3: Emergency. An emergency does exist and this ordinance is deemed to be a continuation of the emergency action commenced in Ordinance No. 2138-96. Section 4: Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. .11/nAK/40 a4Adeif/L a A A.140 D.
