subsequent six month renewal periods by later adoption. Through the adoption of Ordinance No. <br /> 2210-97, the City provided for a second six month renewal period. Ordinance No. 2138-96, as <br /> amended by Ordinance No. 2145-96, Ordinance No. 2173-96, Ordinance No. 2210-97, Ordinance <br /> No. 2245-97 and Ordinance No. 2280-98, is hereby amended and the City hereby adopts a fifth <br /> six(6) month renewal period in order to prevent the moratorium adopted in Ordinance No. 2138- <br /> 96 from in any way terminating or otherwise lapsing. <br /> Section 2: Fifth Renewal Period. Ordinance No. 2138-96 is hereby amended by the <br /> addition of the following section: <br /> Notwithstanding any language in this ordinance, this ordinance shall not terminate or <br /> otherwise lapse. This ordinance is hereby renewed and extended for a fifth additional six (6) <br /> month renewal period. During this period, the work plan implemented during the first, second, <br /> third and fourth six (6) month extensions to the moratorium shall continue to be implemented <br /> through the monitoring of the litigation and defending the challenges concerning the City's adult <br /> use policy and_regulatory strategy. <br /> Section 3: Emergency. An emergency does exist and this ordinance is deemed to be a <br /> continuation of the emergency action commenced in Ordinance No. 2138-96. <br /> Section 4: Severability. If any section, subsection, sentence, clause, phrase or word of <br /> this ordinance should be held to be invalid or unconstitutional by a court of competent <br /> jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or <br /> constitutionality of any other section, subsection, sentence, clause, phrase or word of this <br /> ordinance. <br /> .11/nAK/40 a4Adeif/L <br /> a A A.140 D.
